Beirut bar cancels event inviting guests to dress as domestic workers

BEIRUT: A bar in the neighborhood of Gemmayzeh has canceled an event, originally scheduled for this Friday, which invited guests to dress up as migrant domestic workers for the chance to win $100.

Event details encouraged bar-goers to, “this Friday night, be Sinkara or Milenga ... be Soumatra or Domma ... create your own maid costume, speak like them and look like a Philippino [sic], Bengladish [sic], Sri Lanka [sic] or any maid you want and definitely win 100 U.S. dollars in cash.”

The details of the event were originally posted late Tuesday evening on the bar’s Facebook group. A Lebanese organization, the Anti-Racism
Movement, then reposted the event on its blog, which soon drew much online criticism. The owner of the bar then removed all details of the event.

Speaking to The Daily Star Wednesday, the owner denied that the event was in any way racist. “You just put on a costume, it was supposed to be for fun. Some people misunderstood it and thought it was racist.”

On the emphasis on foreign nationalities in the posting, she said “We hadn’t meant it in that way at all. You didn’t have to dress as a foreigner, you could have just put on an apron and dressed as your mom.”

“We took the event down after two hours, as we realized people had misinterpreted it.”

Farah Salka, of the Anti-Racism Movement, called it one of the most shocking recent examples of racism that she has seen.

“I see examples of it all the time, but with this, I was just like ‘wow.’”

While happy that the event was removed so quickly, Salka said she was disappointed the owner had not apologized for posting it in the first place.

“I would love to buy her explanation that it was not intentionally racist, but how can it not be? When you are categorizing the 250,000 migrant domestic workers in this country as ‘them:’ Who is ‘them’?”

The event details also equated the $100 award for the best costume with the salary maids receive, writing: “They ... work all the month to get it,” but that bar-goers could claim the same amount back by “imitat[ing] them and win it in some few comedy moments.” Salka said this was “completely insensitive.”

It is time, Salka added, for a redefining of the word “racist” in Lebanon. “We need to revise the definition. Even the smallest details can be racist,” she said.

Fashion and human rights unite at Beirut event

BEIRUT: Though it might seem an odd event for highlighting the challenges facing migrant domestic workers in Lebanon, the Insan Association took on the issue with a fashion show, hoping to open people’s eyes to the fact that beauty comes in all colors.

Behind the Green Door in Gemmayzeh presented the show, “Celebrating Colors,” Wednesday night to a packed audience. It featured creations by up and coming Lebanese designers, modeled by women from backgrounds representing Lebanese and immigrant communities in Beirut.

According to event organizer Joana Hauff from the Insan Association, the idea for a fashion show came as a new tactic to raise awareness about the plight of migrant workers and immigrants in Lebanon, in a way that roundtables and news conferences cannot.

“This event was supposed to target the broad public and the aim was to attract a different kind of crowd that would usually not show up to our events and not already be sensitized to the issue,” explained Hauff.

The Insan Association is a human rights and humanitarian organization that works with marginalized communities in Lebanon – including refugees and migrant workers. The nonprofit provides direct educational, legal and psychosocial services to individuals and families.

Carried out in cooperation with Spanish NGO, AIDA, with funding from the Spanish Cooperation (AECID), Wednesday’s event was part of an ongoing project meant to extend Insan’s awareness work by emphasizing “empowerment and social inclusion” of migrant workers in Beirut.

“The fashion show did two things: It showed that there are many different creative people who are willing to support our cause and stand up for better rights for MDWs [migrant domestic workers] and it gave the women the chance to be perceived in a different light, to feel confident and beautiful,” Hauff told The Daily Star.

The models – from Lebanon, Canada, Cameroon, Nepal and Congo – wanted to show equality by taking to the catwalk together.

“Migrant workers are not treated as human beings here. I wanted to raise awareness that beauty comes in all shapes and sizes,” said Canadian model Julie Davidson.

Her compatriot, Micheline Kabenge from Congo participated to show that immigrants to Lebanon are not just defined by their jobs.

“Just because we work in houses and kitchens does not mean we’re different. We can work in offices. We can work in any job that anyone else can work in ... it’s not your color that differentiates you but your brain.”

Kabenge moved to Beirut with her Lebanese husband and son six years ago. Her husband passed away and his family has separated her from her child. Kabenge hopes that her efforts will help the Lebanese become more accepting, so other women do not experience the heartache that she has gone through.

Though the women participating in the show had different backgrounds they were there to represent other immigrants and domestic workers who do not have the same level of independence that they do – symbolized by masquerade masks worn during their opening walk through the venue.

“Our message, represented by the masks, was there are thousands of women living in this society that are being unseen, deprived of their identity and freedom and their basic rights,” said Hauff.

There are approximately 200,000 migrant domestic workers living in Lebanon, working mostly as maids. Legal measures protecting their rights are insufficient and as many as half of these women have lost their legal status, which is tied to a contract with a single employer.

The Insan Association has organized a roundtable Monday with Labor Minister Charbel Nahhas, activists and representatives of various NGOs and embassies to discuss legal protections.

The nonprofit also hopes to use the photos taken at the door of Wednesday’s event of every attendee in a campaign to show the wide support for this cause, Hauff added.

“All these women are beautiful, proud and should have the opportunity to be who they want to be.”

Lebanese Minister of Labor promises to abolish sponsorship "kafala" system

On Monday 23 January 2012, Lebanese Minister of Labor Charbel Nahas declared unacceptable that the Lebanese continue to hire foreign labor they violate the rights, as they continue to rush to the gates of the embassies in search of work and foreign passports. He added: "I am against the confinement of domestic workers, I am for having a fixed work schedule, but with the possibility of flexibility in specific cases," arguing for a standard contract of work, binding, and refusing the idea of a specific law to foreign domestic workers.

Minister Nahas' "revolutionary" declarations came during a conference organized by Insan Association at La Sagesse University in Beirut on "Empowerment and Social Inclusion of Migrant Domestic Workers in Lebanon", while sitting in between
the Spanish Ambassador to Lebanon and the Dean of the Faculty of Law in La Sagesse. This is a major shift in policy with previous ministers of labor and came as a surprise to all conference participants.

Minister Nahas explained "so-called system of the sponsorship or guarantor (kafala) does not exist in Lebanese law." He clarified that the term was imported from Arab countries where the practice is common, and brought into practice in Lebanon by the Lebanese General Security.

Today, Nahas reiterated via his Twitter account his refusal of a bill specific to foreign domestic workers. "Any labor law that takes into account the nationality of the worker is tantamount to racial discrimination," he wrote in Arabic.

Earlier in 2011, UN Special Rapporteur on Contemporary forms of Slavery, Ms. Gulnara Shahinian, refrained from suggesting to abolish the sponsorship system in Lebanon because, as Ms. Shahinian has said, she did not have time to explore the alternatives to the sponsorship system, and she did not view labor laws as a viable alternative. Equally, minister Nahas is going against the current global legislative trend which separates domestic work from normal labor as embodied in the recent work towards a Convention on Decent Work for Domestic Workers.

Minister Nahas' overarching policy in the ministry of labor is to favor Lebanese over foreign workers. This has recently led to a significantly higher rate of denial of work permits to foreigners requested by Lebanese employers. In the words of minister Nahas, "we cannot keep exporting our youth and importing foreign workers".

Déterminé à prendre en main le dossier de la main-d’œuvre domestique étrangère, le ministre du Travail Charbel Nahas propose une solution controversée : intégrer cette question au code du travail.

Faut-il ou ne faut-il pas une loi propre à la main-d’œuvre domestique étrangère ? C’est sur cette question qu’a tourné le débat, par moments enflammé, qui s’est déroulé hier à l’Université La Sagesse, sur la protection légale des employées de maison
migrantes au Liban. Un débat qui a mis en exergue la ferme détermination du ministre du Travail, Charbel Nahas, de soumettre la main-d’œuvre domestique migrante à la loi du travail et son refus catégorique d’un projet de loi spécifique à cette catégorie de travailleurs. Mais qui a laissé sans réponse de nombreuses questions sur les moyens envisagés pour y parvenir et pour amener la société libanaise dans son ensemble, autorités et employeurs, à respecter les droits des employées de maison étrangères, qui continuent d’être victimes d’abus au quotidien.

Un dossier qui va à reculons
Assailli de questions, suite à une intervention fort intéressante sur l’histoire du travail à domicile au Liban et les raisons de l’absence de législation, le ministre Nahas s’est carrément emporté devant une assistance sceptique face à sa proposition de gestion du dossier, jugeant inadmissible que les Libanais continuent d’embaucher une main-d’œuvre étrangère dont ils bafouent les droits, alors qu’ils continuent de se presser aux portes des ambassades en quête de travail et de passeports étrangers. « Je suis contre l’enfermement des employées de maison, je suis pour qu’elles aient un horaire de travail fixe, mais avec possibilité de flexibilité dans certains cas précis », a-t-il tempêté, plaidant pour un contrat type de travail, à caractère obligatoire, et refusant l’idée d’une loi spécifique à la main-d’œuvre domestique étrangère. Avant de se retirer face à un auditoire médusé, dont l’ambassadeur d’Espagne, Juan Carlos Gafo, persuadé de la nécessité d’une législation (sous n’importe quelle forme) qui protégerait les droits des travailleurs migrants, et de nombreux représentants d’associations et d’organisations luttant pour les droits de la main-d’œuvre migrante.
Le débat est loin d’être clos. Bien au contraire. Organisé par la faculté de droit de La Sagesse, en collaboration avec l’association Insan, l’organisation espagnole Aida et le ministère espagnol des Affaires étrangères, il montre, plus que jamais, l’urgence du problème et la nécessité de le traiter avec sérieux. Il ne fait pas l’ombre d’un doute que Charbel Nahas soit déterminé à s’y atteler, à l’heure où, comme l’a si bien dit un diplomate étranger, la situation de la main-d’œuvre domestique étrangère « va à reculons, au lieu de s’améliorer ».
D’autant que le ministre du Travail a fait appel aux conseils d’un brillant avocat, Nizar Saghyeh, dont la réputation n’est plus à faire en matière de défense des droits de l’homme. Mais il semble que M. Nahas ait décidé de repartir à zéro en prenant un chemin nettement opposé à celui de son prédécesseur, Boutros Harb, qui avait présenté, avant la chute du gouvernement Hariri, un projet de loi régissant le travail de la main-d’œuvre étrangère domestique. Un projet fort louable, salué par la société civile, mais qui comprenait néanmoins d’importantes imperfections. À titre d’exemple, il avait fait l’impasse sur la liberté de circulation des employées de maison et sur le montant de leur salaire.

Illégal, le système du garant
Il n’en reste pas moins que la tâche ne s’annonce pas aisée, face aux défis du dossier. Vu les grandes disparités tant au niveau des données statistiques que des solutions proposées. À titre d’exemple, le ministère du Travail estime à 140 000 le nombre d’employées de maison migrantes en situation régulière. Il estime aussi entre 20 000 et 30 000 le nombre de femmes migrantes travaillant en situation irrégulière au Liban. Mais selon Insan, par le biais de son porte-parole Charles Nasrallah, le nombre de personnes en situation irrégulière serait nettement plus important et pourrait atteindre 80 000 personnes, portant le total de la main-d’œuvre étrangère à 220 000 personnes. Un problème qui n’est pas à négliger vu l’extrême précarité de cette population étrangère sans papiers dont les enfants naissent apatrides et sombrent souvent dans la délinquance.
Autre défi du dossier, le système du garant qui régit les relations entre l’employée de maison et son employeur. Un système dénoncé tant par les associations comme Insan que par les ambassades occidentales, au même titre que les pays dont sont originaires les travailleuses étrangères au Liban. Un système qui met l’employée de maison à la merci de son employeur et garant, et la place ainsi en situation d’esclavage. Et pourtant, martèle le ministre Charbel Nahas, « ce qu’on appelle système du garant n’existe pas dans la loi libanaise ». Et de préciser que le terme a été importé des pays arabes où cette pratique est courante. M. Nahas omet toutefois d’expliquer pourquoi la Sûreté générale et le ministère du Travail refusent de donner leurs passeports et leurs papiers justificatifs aux femmes migrantes, mais les remettent en mains propres à leurs employeurs qui les confisquent carrément, comme garantie contre la fuite de leur employée.
L’affaire est à suivre. « Le débat était fructueux, même s’il était orageux », n’a pas manqué de commenter le doyen de la faculté de droit, Maroun Boustany. La balle est désormais dans le camp du ministre du Travail. À lui de prouver sa détermination à traiter un dossier épineux qui n’en finit pas de noircir l’image du Liban et des Libanais. Et qui continue de faire du surplace depuis tant d’années.

نحاس يرفض وضع قانون خاص بـ«الخدم»: «القضية ليست شفقة وجمعيات بل حقوق عامل»

جاء النقاش الذي شهدته أمس، الطاولة المستديرة التي نظمتها «مؤسسة إنسان» حول «الحماية القانونية لعاملات المنازل الأجنبيات في لبنان»، بمشاركة وزير العمل شربل نحاس، في كلية الحقوق في جامعة الحكمة، «على شاكلة» النقاش الذي دار على مدى ثلاثة أشهر حول موضوع تصحيح الأجور في البلاد.
مرة جديدة، غرّد الوزير «المشاكس» خارج السياق التقليدي لطريقة طرح القضايا وجاءت مواقفه متقدمة بأشواط على مواقف بعض الجمعيات العاملة على رفع الانتهاكات بحق العاملات المنزليات.
وإذا كان نحاس، كوزير للعمل، قد رفض التعامل مع تصحيح الأجور من منطق «المكرمة»، رفض التعامل مع عاملات المنازل الأجنبيات في لبنان من باب «الشفقة والمنة» أو لمجرد تحسين صورة اللبناني كمواطن، ولبنان كبلد، أمام المجتمع الدولي.
وأكد نحاس أن إحصاءات وزارة العمل تبين وجود نحو 140 الف عاملة أجنبية في المنازل، بالإضافة إلى نحو عشرين إلى ثلاثين ألف عاملة من دون اوراق رسمية، وهو ما يوازي عدد العاملين في القطاع العام في لبنان من موظفين وعسكريين وغيرهم، وهو ما يدل على حجم ما نتحدث عنه.

وقد فاجأ نحاس الحضور، ومن بينهم السفير الإسباني في لبنان، وبعض الجمعيات العاملة في حماية العاملات المنزليات الأجنبيات، وعدد من الناشطين، برفضه تخصيص هذه الفئة من العمال بقانون عمل خاص. وهو رفض لم يفهم عدد كبير من الحضور مغزاه أو دوافعه النابعة من نظرة اجتماعية اقتصادية للقضية.
وهدف نحاس، عبر رفضه تخصيص العمّال الأجانب بقانون عمل خاص، إلى «عدم تكريس نمط مجتمعي سائد حالياً لجهة النظر إلى العمل في المنازل كأنه خدمة وليس عملاً يؤدى في مقابل أجر»، كما أكد لـ«السفير»، مشيراً إلى «أن العمل هو عمل مهما كان نوعه، وأن الذي يؤديه هو إنسان له حقوقه وعليه واجبات، بغض النظر عن جنسيته».
واعتبر نحاس أن تخصيص العاملات المنزليات بقانون لكونهن أجنبيات، يكرس فرضية أن «وضعهن القانوني يختلف عن العمال الآخرين، وهو ما يدخلنا بدهليز لا نعرف نهايته»، مؤكداً أن «أي قانون عمل يأخذ بالاعتبار جنسية العامل هو بمثابة تمييز عنصري».
وسأل نحاس إن كان اللبنانيون الذين يعملون في الولايات المتحدة والخارج، يقبلون بأن يرعاهم قانون عمل خاص بهم غير ذلك الذي يطبق على جميع عمال البلاد التي يعيشون فيها.
وأكد نحاس أن القضية ليست «مسألة خيرية وجمعيات، وإنما تتعلق بنمط مجتمعي ككل متكامل»، وأنه «يجب عدم تكريس التمييز السلبي انطلاقا من التعاطي بمفهوم الشفقة ومحاولة تجميل الواقع».
وقدم نحاس عرضاً تاريخياً لنمط العمل في المنازل الذي كان سائداً في لبنان في ستينيات القرن الماضي «حين كانت عاملات المنازل غالبا من الأرياف ومن مختلف الطوائف، وكان أهلها يضمنون حمايتها، وبامكانها الاستقالة إن اسيئت معاملتها».
أما السيدة الأجنبية، وفق نحاس، فمحكومة بعنصر إضافي من شأنه أن يخل بميزان القوى في علاقتها برب العمل، ويتمثل ببعد بلادها عن لبنان، وبارتفاع كلفة الإتيان بها عن مدخولها الشهري، وبالتالي عدم قدرتها على الانسحاب في حال عدم ارتياحها إلى ظروف العمل.
في المقابل، هناك رب العمل الذي يعتبر انه بدفعه أمواله، (لمكاتب الاستخدام والدوائر الرسمية وتذكرة السفر)، فقد «بدأ استثمارا، وأن لديه الحق باسترداد الاستثمار وباستهلاكه»، وبذلك جاء عقد العمل ليسمح لرب العمل بأن يعوض استثماره الأساسي وليربط علاقة العمل بالإقامة، مع الاستعانة بالقوى الأمنية (وهي هنا الأمن العام) لتكريس الاقتناع بأن فترة العمل المتفق عليها غير قابلة للنقض.
ورأى نحاس أن هذه الوضعية والفلسفة للاستثمار «أنتجتا التسمية اللعينة المعروفة بـ «الكفيل»، حتى بتنا نتحدث في لبنان عن نظام الكفيل، وهي كلمة استعرناها من الدول الخليجية، بعدما استوردنا منهم قادة وزعماء».
وكشف نحاس عن مسعى يعمل عليه في الوزارة مع فريق عمله لـ «فصل علاقة العمل عن الدين أو الاستثمار (أي المبلغ الذي يدفعه رب العمل للإتيان بالعاملة المنزلية)». ويرتكز المسعى على إدخال طرف ثالث في العلاقة غير المتكافئة بين العاملة وبين رب العمل، يضمن دفع الراتب بآلية منتظمة (ربما عن طريق حساب في مصرف)، كما يضمن استمرارية عقد العمل بما لا يلغي حق رب العمل، لكن ضمن الأطر الإنسانية وحفظ كرامة العامل.
وعلمت «السفير» من مصادر موثوقة أن الطرف الثالث ربما يكون المؤسسة العامة للاستخدام التابعة لوزارة العمل، وأن المسعى يرتكز على إبعاد القبضة الأمنية عن الموضوع، مع التأكيد على أن هذه الخطوة لم تتبلور بشكلها النهائي بعد.
وأكد وزير العمل أنه، بعد «إرساء مفهوم الفصل بين علاقة العمل وبين الدين، وإرساء الأمر بالممارسة لأنها الأساس، يصبح الحديث عن شمل العمال الأجانب بقانون العمل الناظم، طبيعيا.. فالحديث هنا لا يختلف عن النقاش حول بدل النقل المزيف وفصله عن الأجر».
وكمسألة بدل النقل، أشار نحاس إلى أن «خفض راتب العاملة في المنزل عن الحد الأدنى للأجور بسبب اقتطاع بدل تأمين منامتها لدى رب العمل ومصاريفها وإطعامها، يجب أن يأتي في سياق متكامل يحفظ كرامتها وحقوقها كإنسان وكعامل».
وبعد نقاش ومداخلات للحضور، اعترض خلالها البعض على رفض الوزير تخصيص العاملات الأجنبيات في المنازل بقانون خاص بهن بطريقة أثبتت أن بعض الحاضرين لم يدركوا المغزى الحقيقي من كلام وزير العمل، رد نحاس مؤكداً أن «لا وجود لشيء اسمه عاملات منزليات أجنبيات، ولا شيء اسمه خصوصية عمل منزلي لأنه استتباع، وهو عملياً يؤدي إلى قصور في الرشد السياسي، بل هناك شيء اسمه إنسان وعامل».
وأكد نحاس أن العمل في المنزل لا يعطي لأي كان الحق في جعل العاملة تعمل لخمس عشرة ساعة أو ما يزيد، وأن حرمة المنازل لا تتيح لمطلق شخص أن يحتجز العاملة ويقفل عليها في غرفة، وان اختلاف الجنسية لا يسمح بالتمييز ضد العامل»..
وبعدما استمر بعض الحاضرين في التساؤل عن رفضه تخصيص العاملات الأجنبيات في المنازل بقانون، ترك نحاس اللقاء بعدما قال للحاضرين «هذا المجتمع كله سوا مش عاجبني إذا كان عاجبكم، يكفي أننا نصدر شبابنا ونستورد عمالة أجنبية». وغادر.

طاولة مستديرة في "الحكمة" عن عاملات المنازل الاجنبيات

اقامت "مؤسسة انسان" بالشراكة مع منظمة aida الاسبانية وبتمويل من الوكالة الاسبانية للتنمية والتعاون، قبل ظهر اليوم، طاولة مستديرة بعنوان "الحماية القانونية لعاملات المنازل الاجنبيات في لبنان" في جامعة الحكمة - فرن الشباك، شارك فيها وزير العمل شربل نحاس، سفير اسبانيا في لبنان خوان كارلوس غافو، مؤسس ومدير "مؤسسة انسان" شارل نصرالله وعميد كلية الحقوق في جامعة الحكمة الدكتور مارون البستاني.
وحضر رئيس جامعة الحكمة الخوري كميل مبارك وممثلون وسفراء وقناصل البلدان التي لها عاملات في لبنان وحشد من المهتمين.

بداية تحدث البستاني فقال: "يسر كلية الحقوق في جامعة الحكمة ان تستضيف هذه الندوة بالتعاون مع مؤسسة انسان حول صعوبات وتحديات العمالة الاجنبية في لبنان وخصوصا العمالة المنزلة الاكثر شيوعا والاقل حماية. ان هذه المشاركة بين كليتنا وهذه المؤسسة الزائدة تعود الى سنوات عديدة وقد اعطيت افضل الثمار وان مناهجنا لا تقتصر فقط على المواد القانونية التقليدية المطلوبة في الامتحانات الرسمية والنقابية، بل ادخلنا في مناهجنا مواد قانونية اخرى، عادة يشار اليها همسا في المناهج، ولكنها تهم قضيا المجتمع ومنها قضية العمالة الاجنبية".
اضاف: "ان فوائد هذه الندوة عديدة نكتفي منها بذكر ثلاثة:
الفائدة الاولى: تتعلق بانتشار ظاهرة العمالة المنزلية التي امست في لبنان نمط عيش للعائلات المقتدرة وحتى للعائلات غير الميسورة واصبحت مجال تباه في بعض الحالات امام ربات المنازل.
الفائدة الثانية: في العمالة المنزلية، تكون العلاقة بين رب العمل والعاملة المنزلية علاقة يشوبها الغموض، ومن اللافت وجود فراغ تشريعي كبير في كل ما يتعلق بالحقوق للعاملات الاجنبيات.
الفائدة الثالثة: كون هذا الفراغ قد ادى الى اساءة استعمال رب العمل واحيانا ربات العمل لسلطتهم مما ولد تجاوزات مشينة يعاقب عليها القانون، وخير دليل على ذلك سوء المعاملة من قبل بعض العائلات اللبنانية للعاملات المنزلية التي تستقدمها معها الى الخارج مما اثار فضائح تناولتها وسائل الاعلام واساءت الى سمعة اللبنانيين.
لكل هذه الاسباب وسواها تكتسب هذه الندوة فائدة كبيرة عسى ان تساهم في حل هذه المعضلة الشائكة التي لم يعد بالامكان التغاضي عنها".

ثم تكلم نصرالله فقال: "تشكل عاملات المنازل الاجنبيات جزءا كبيرا جدا من مجتمع المهمشين في لبنان وتحدد مؤسسة انسان المهمشين بمن وقعوا ضحية اهمال القانون لوجودهم واهمال الادارات الرسمية لحاجاتهم ورذلهم مجتمع الاكثرية لعوزهم وضعفهم وفقرهم واحيانا للون بشرتهم او لمعتقدهم. ان العمالة المنزلية هي قضية عرضة الى عوامل ثقافية واجتماعية واقتصادية وان استثناء قانون العمل اللبناني لهذه المهنة هو المسبب الاساسي لتمادي الانتهاكات بحق تلك العاملات لذا نجد في مؤسسة انسان انه لم يعد من المقبول السماح لقانون العمل اللبناني الاستمرار بالتمييز ضد هؤلاء الناس".
اضاف:"على قانون العمل ان ينظم كل العمل في لبنان ويحمي كل العمال ويحدد حقوقهم وواجباتهم مع المراعاة التامة للمعايير الدولية لحقوق الانسان التي يكفل الدستور اللبناني حمايتها، ونجد ايضا ان نظام الكفالة وعلى الاقل بشكله الحالي، الذي يربط مصير العاملة في لبنان بيد انسان واحد هو الكفيل، يخلق علاقة ارتباط مصيري لضعيف بقوي وهذا من ابرز صفات العبودية. عليه نجد انه من الضروري اعطاء طرفي العقد (العامل وصاحب العمل) الحق بالتساوي وضمن اطر قانونية واضحة تضمن حقوق الطرفين، الحق بوضع حد للعقد واستبدال الطرف الاخر بغيره ضمن القانون على غرار اي عامل واي صاحب عمل، وايضا ان اي قانون لتنظيم العمل في المنازل يجب ان يحترم حدوده ويلزم جميع الاطراف المتعاقدة على اساسه احترام حدودها فهو ينظم العمل ولا ينظم حياة المتعاقدين وليس له ان يحرم اي طرف من حقوق كرست تكريسا مقدسا غير قابلة للبحث والنقاش ولوجهات النظر، الحقوق الاساسية والطبيقية للانسان".
ثم تحدث السفير غافو فأشار الى ان "العاملات الاجنبيات في المنازل هن اللواتي حقوقهن ضائعة".
وشكر "المجتمع المدني في لبنان لتوعية المواطنين ليدركوا انهم امام مجتمع من المستضعفين في المجتمع".
وهنأ وزير العمل شربل نحاس للعمل على "اقرار قانون يضمن حقوق العاملات الاجنبيات في المنازل اللواتي يأتين من بلدان ممثليهم موجودين معنا".
وتمنى ان "نصل الى ايجاد حماية فاعلة لجميع عاملات المنازل اللواتي يعملن في لبنان".
وختم متوجها الى "مؤسسة انسان" معلنا بأن السفارة الاسبانية والوكالة الاسبانية للتنمية والتعاون ومنظمة ؟ "ستستمر في دعمكم مع وجود وزير عمل في لبنان مثل شربل نحاس يؤكد دعم حقوق العاملات الاجنبيات في المنازل".

واخيرا القى نحاس كلمة تحدث فيها عن موضوع الخدمة المنزلية من ناحية تاريخية. فقال: "في الستينيات كانت "الصناع" لبنانيات ويأتين من المناطق الريفية القريبة للمدن ولم ينحصرن لاية طائفة. وفي الستينيات العمال المنزليون الاجانب تكاد تكون عمالتهم محصورة عند بعض الاثرياء اللبنانيين الذي كانوا في مصر ويقومون باستقدام العمال السودانيين. ثم بدأت تأتي عاملات من سوريا وبعد الحرب اختلف المجتمع الذي فيه عمالة منزلية اجنبية".
واشار الى انه "لا يوجد شعوب ذوات وشعوب خدام انما يتعلق الامر بحاجات الشعوب اكان على الصعيد الاقتصادي المتدهور في بلد ما او هربا من الوضع الامني وغيره".
واضاف: "ان الاحصاءات عن الاسر في لبنان التي لديها خادمات حسب معايير عدة منها هل هناك اولاد تحت العشر سنوات؟ هل هناك مسنون فوق ال 65؟ هل هناك معوقون؟ هل المرأة تعمل؟ وطبعا ما مدى دخل الاسرة؟ والجواب كان ليس بسبب وجود الاولاد في المنزل تستقدم الخادمات وليس بسبب عمل المرأة ولا وجود مقعدين وغيره من الاسئلة، بل ان سبب وجود عاملات في المنازل لدى الفئة الثرية من المجتمع اي 90 في المئة هو مستوى الدخل المرتفع الذي يستقدم خدم المنازل".
وتابع: "حسب الاحصاءات المتوافرة في وزارة العمل لدينا حوالي 140 او 150 او 160 الف خادمة اجنبية تعمل في المنازل وهذا العدد يوازي عدد العاملين في القطاع العام من موظفين واساتذة وعسكريين وهذا هو حجم الموضوع الذي نتكلم عنه".
ولفت الى انه "من ناحية القانون فقانون العمل في العام 1946 استثنى الخدام وكل القطاع الزراعي. وفي ذلك الوقت كانت "الصانعة" ابنة المزارع والعلاقة كانت تقتصر بين والدها و"الخواجا" وهذه العلاقة الابوية كانت تطال المزارع وابنته الصانعة.
وقال: "قانون العمل وضع على اساس فرضية تفاؤلية وبعده القانون الاجتماعي ايضا اعتبر ان هذا المجتمع الريفي المتأخر الى زوال وسيحل مكانه مجتمع متطور يخضع لقانون العمل والضمان الاجتماعي وما الى ذلك وبالتالي لم يكن يشرع الجزء الذي كان يعتبره على اطراف المشروع التطويري العام. وهذا الامر ما زلنا نعاني منه حتى يومنا هذا وليس فقط في هذا المجال انما ايضا في مجالات عدة لان الضمان الاجتماعي وضع للاجراء فقط وكانت الفكرة ان نسبة الاجراء ستصل الى 70 و80 او 90 في المئة ثم تبين العكس تماما".
اضاف: "ثم صدر مرسوم ينظم عمل الاجانب وضع في اوائل الستينيات، وبدأ يتخرج من لبنان القليل من المهندسين والاطباء وكانت الافضلية للاجانب، ووضع قانون عمل للاجانب ليضع القيود على عمل الخبراء الاجانب لصالح النخب المهنية اللبنانية حينها، ولم يؤخذ في الاعتبار ان يمارس هذا القانون على العاملات الاجنبيات في المنازل، لذلك الاليات الادارية التي ترعى منح او حجب اجازة العمل كانت مصوبة لخدمة هذا الهدف".
واورد ما يقوله هذا المرسوم "لا تجوز اقامة الاجنبي من دون ان تكون اقامته مرتبطة بعمل وان يكون هذا العمل مثبتا اما من خلال عقد او تمثيل شركة اجنبية او صاحب مؤسسة"، اذا هناك ربط بين العمل والاقامة وترك لوزير العمل والشؤون الاجتماعية حينها تنظيم المستندات لتنفيذ هذا المرسوم .
ورأى ان"امام هذه الحالة ارتؤي اصدار قانون للخادمات الاجنبيات وانا لست مقتنعا باصدار قانون للخادمات الاجنبيات، لذلك اضطررنا ان ننظر الى المسألة من زاوية اخرى هي الممارسة والاعتبارات التي تحكم هذه الممارسة فعليا".
واشار الى ان "استقدام العاملات الاجنبيات يخضع لعقد غير قابل للتعديل في خلال فترة سنتين او اكثر تسمح من وجهة صاحب البيت ان يعوض استثماره الاساسي وكون علاقة العمل مرتبطة بالاقامة ولاحقاق حقه يتم الاستعانة بالقوى الامنية (الامن العام) كي تؤكد وتثبت وتكرس اقتناع صاحب البيت ان فترة العمل هذه غير قابلة للنقض، وقال: "من هنا اتت هذه التسمية التي تدعى الكفيل وفي القانون اللبناني لا وجود لكلمة كفيل".
وختم: "هناك عقد عمل يرتبط بالاقامة كي يستعان بالسلطة الامنية المولجة مراقبة الاقامة كي يتم تغطية عقد تمويلي ضمن عقد العمل وان يدخل طرف ثالث في هذه العلاقة غير المتكافئة كي يؤمنوا من ناحية ان هذا التمويل المسبق الذي هو الاستثمار المضبوط ومن ناحية اخرى ان دفع الاجر ايضا مضبوط مقابل ذلك، وبعد الانتصار في هذه المعركة وارسائها في الممارسة يصبح ممكنا اعادة هذا الشق من العمل الى اطار قانون العمل والنظام العام".

Manila to lift workers’ Lebanon deployment ban

BEIRUT: The Philippines says it is ready to lift a deployment ban to Lebanon adopted in 2006 when Manila signs a bilateral agreement with Beirut in January but has warned its citizens against travelling to Syria, the Inquirer Global Nation reported Thursday.

The news website quoted Carlos Cao Jr., chief of the Philippine overseas employment administration, as saying that the
ban on household service workers to Lebanon would be lifted when Beirut guarantees the rights of overseas Filipino workers.

“It is a labor cooperation agreement and the final draft is already finished. The signing will be done in Lebanon,” Cao told the English-language website.

In 2006, Manila imposed a ban on the deployment of Filipino workers to Lebanon over concerns of poor working conditions and reports of abuse against workers, who, according to many rights groups, enjoy little legal protection in the country.

Despite the ban on workers, many Filipinos have reportedly still managed to work in Lebanon by traveling to multiple countries before reaching their destination.

The website also said that reports revealed some Filipino domestic workers in Lebanon and Jordan were treated like “slaves” and were denied their basic rights.

Recent studies estimate that around 40,000 Filipinos work in Lebanon.

The report also said that the country was working on a bilateral agreement with Jordan in a bid to lift the deployment ban in that Arab country.

Under Philippines law, workers are only allowed to be deployed to countries where their rights are ensured and protected by law, something that Lebanon does not yet provide.

Meanwhile, the Foreign Affairs Ministry has warned its citizens against traveling to Syria and the Philippine Embassy in Damascus is arranging the repatriation of 143 domestic workers.

“Before the end of the year, more than 60 Filipinos in Syria were scheduled to be repatriated to the Philippines. The Philippine Embassy in Damascus is also arranging the repatriation of another 143 OFWs [Oversees Filipino Workers] from that country,” Raul Hernandez, a spokesperson at the Foreign Affairs Ministry, told the Philippine Daily Inquirer.

He also said that the department had been able to repatriate close to 400 of its citizens so far, adding that the government had begun the repatriation process since April.

Syria has witnessed escalating violence since mid-March, when anti-government protests were being met with a deadly crackdown by security forces. The United Nations has estimated that around 5,000 people have been killed since the uprising began.

قانون الاتجار بالبشر كمدخل لإنصاف العاملات في المنازل

هبطت الطائرة الآتية من العاصمة السريلانكية كولومبو، فحملت ديفراني سامراني حقيبتها الصغيرة، وتوجهت عبر الممر الصغير باتجاه صالة الاستقبال. «أهلا بكم في مطار بيروت الدولي»، قالتها إحدى المضيفات باللغتين العربية والإنكليزية، ومع ذلك، لم تصدق ديفراني ما يحصل معها.
كانت السيدة الأربعينية قد تقدمت بطلب إلى أحد مكاتب الاستخدام في سريلانكا مشترطة إرسالها للعمل في إحدى دول الخليج، وبالتحديد الكويت.
كانت العاملة المنزلية ديفراني، قد قضت إبان حرب الخليج، عشرة أعوام في كنف إحدى الأسر الكويتية، خرجت منها بتجربة «ممتازة» على صعيد المعاملة الشخصية والحقوق المالية: «كنت كابنة لهم»، تقول. ولذلك، أرادت العودة للعمل في البلد عينه، وها هي تجد نفسها في بيروت من دون أن توافق، أو حتى تدري.

وفي ظل عدم وجود قانون خاص بعاملات المنازل في لبنان، لم تستطع ديفراني الاعتراض على تسفيرها إلى لبنان بدلاً من الكويت. قال لها صاحب مكتب الاستخدام، رداً على احتجاجها، إنه يتوجب عليها أن تعمل لترد كلفة الإتيان بها التي تكبدها المكتب والعائلة المستخدِمة، كما تأمين ثمن تذكرة العودة، وغيرها من المصاريف. وبذلك، استسلمت ديفراني للأمر الواقع، وباشرت عملها وفقاً لشروط مكتب الاستخدام ورب العمل.
مع إقرار المجلس النيابي اللبناني خلال شهر آب الماضي للقانون رقم 164 الخاص بـ«معاقبة جريمة الإتجار بالبشر»، علّق أحد المحامين المناصرين لقضايا حقوق الإنسان، ومن بينها أوضاع العاملات الأجنبيات في لبنان، بالقول: «أصبحنا، كمحامين مناصرين لقضايا الإنسان، قادرين على الإيقاع بمنتهكي حقوق العاملات في المنازل».
إذ يرى المحامي أن «نواب الأمة، تحت ضغوط الجهات الدولية، وعلى رأسها السفارة الأميركية في لبنان، تجاوبوا مع إقرار قانون يعاقب على جريمة الإتجار بالبشر من دون التدقيق ببنوده بعمق، ومن دون الانتباه إلى تأثيراته الإيجابية على وضع عاملات المنازل، وخصوصاً إتاحته معاقبة منتهكي حقوقهن من قبل افراد في بعض العائلات اللبنانية».
«استغلال» بنود لإحقاق الحق
صحيح أن «المعاقبة على جريمة الإتجار بالبشر» قد تفسر، بشكل مباشر، بمعاقبة مستغلي النساء اللواتي يتم استقدامهن للعمل في لبنان تحت عنوان «الاستعراض والفن»، ومن ثم يجري تشغيلهن في الدعارة، بالإضافة إلى كل ممارسات الإتجار الأخرى الخاصة بتشغيل الأطفال والبالغين في التسول أو الدعارة، كما في بيع الأطفال، أو احتجاز حرية الغير بهدف الاستغلال، لكن قراءة جدية للقانون 164 تشير إلى قدرة القانونيين على الاستفادة من إقرار المعاقبة على الإتجار بالبشر، لحماية العاملات ألأجنبيات في المنازل أيضاً.
ويرى الناشط في مجال حقوق الإنسان المحامي والباحث القانوني نزار صاغية أن بنوداً عديدة في قانون معاقبة جريمة الإتجار بالبشر تنطبق على وضع العاملات الأجنبيات في المنازل. ويبدأ صاغية من البند الأول من المادة 568 التي تعرّف الإتجار بالأشخاص على انه «اجتذاب شخص أو نقله أو استقباله أو احتجازه أو إيجاد مأوى له»، بواسطة «التهديد بالقوة أو استعمالها، (البند ب من المادة نفسها)، أو الاختطاف أو الخداع، أو استغلال السلطة أو حالة الضعف، أو تلقي مبالغ مالية أو مزايا... أو استعمال هذه الوسائل على من له سلطة على شخص آخر». ويمكن للقانونيين الاستفادة من هذين البندين في ما يتعلق، وفق صاغية، بعناصر «النقل والخداع (عدم إطلاع العاملة على ظروف العمل الحقيقية أو البلد الذي تنقل إليه)، وكذلك عبر استغلال حالة ضعف الضحية»، وهو ما يحصل في غالبية الانتهاكات الواقعة على العاملات.
ويمكن لاستغلال الضحية أن يترجم بدءاً من لحظة قصد منزلها في بلدها الأصلي، وهي تعاني الجوع والفقر والعوز لتلبية احتياجات أولادها، ومن ثم اجتذابها (كما ورد في البند «أ») إلى بلد ثان.
ويتوقف صاغية عند الفقرة «ج» من القانون 164 التي تشرح الهدف من الإتجار، ومن بينها «استغلال» الضحية أو «تسهيل استغلالها من الغير». ولعل من النقاط الهامة جداً في الفقرة «ج» هو القول بأنه «لا يعتّد بموافقة المجني عليه في حال استعمال أي من الوسائل المبينة في المادة 586». أي أن مرتكب جرم الإتجار لا يمكنه التذرع بموافقة الضحية، للإفلات من العقاب.
وينتقل صاغية إلى تعريف ضحية الإتجار والاستغلال حيث ينص القانون على اعتبار الاستغلال «إرغام شخص على الاشتراك في أفعال يعاقب عليها القانون أو الدعارة أو استغلال دعارة الغير، كما الاستغلال الجنسي». وينطبق جرم الاستغلال الجنسي على بعض حالات الانتهاك لحقوق العاملات في المنازل، حيث يجري التحرش بهن في معظم الأحوال، وإرغامهن على ممارسات تقع في الإطار نفسه. وتعبّر مظاهر التحرش الجنسي عن نفسها، على سبيل المثال لا الحصر، في إرغام العاملة على مساعدة رب المنزل في الاستحمام، أو القيام بتدليكه، أو على الدخول في علاقة جنسية معه أو مع الأبناء الذكور في العائلة، وصولاً إلى الاغتصاب في حالات كثيرة.
ويضع القانون، وفق صاغية، ممارسة الاسترقاق، أو الممارسات الشبيهة بالرق (البند هـ)، في خانة الاستغلال الذي يؤدي إلى الإتجار بالبشر، وكذلك البند «و» الذي يحدد العمل القسري أو الإلزامي، ما يتيحه «نظام الكفالة الذي ينتج ظروفاً من شأنها تسهيل هذه الممارسات»، كما يؤكد. وغالباً ما لا تتمكن العاملة في المنزل من مغادرة مكان عملها بسبب فقدانها أوراقها الشرعية التي يحتفظ بها رب العمل.
كما أن العقد المفروض من قبل الدولة على مستوى العقود المبرمة بين العاملة في المنزل وبين رب العمل، تحت صيغة «موحد»، يقول بعشر ساعات عمل للخادمة. وهنا، يسأل صاغية إن كانت عاملات المنازل في لبنان يعملن لعشر ساعات فقط في اليوم، عدا عن خصوصياتهن المفقودة، وعطلهن المصادرة.
قلب المعادلة.. بانتظار إلغاء «الكفالة»
يشير صاغية إلى أن العقد الحالي يتيح للعاملة المنزلية خيارين فقط لفسخه في حال رفض رب العمل التنازل عنها لكفيل آخر. وبالتالي، يمكن للخادمة إما الهرب أو العودة إلى بلادها بعد دفع كلفة الإتيان بها، إن هي فسخت العقد. ومع هروب الخادمة، تفقد أوراقها الشرعية، من إقامة وجواز سفر، لتصبح مقيمة غير شرعية، ومخالفة للقانون، أو أنها تعمل «قسرياً» ورغماً عنها لرد كلفة استقدامها، مما يضعنا في قلب «استعباد البشر».
ويلفت صاغية إلى أن العاملة في المنزل لم تكن تعتبر «ضحية إتجار قبل صدور القانون، كما لم يكن الكفيل تاجراً بالبشر»، ولكن اليوم، ومع «توفر شروط تطبيق القانون، يصبح وضع العاملة المنتهكة الحقوق، مماثلاً لوضع ضحية الإتجار بالبشر، ويصبح الكفيل ملاحقاً جزائياً».
ويذهب صاغية إلى أبعد من معاقبة الكفيل منتهك حقوق العاملة، وذلك إلى نص القانون نفسه على إعفاء عاملة المنزل، ضحية الإتجار بالبشر، من الملاحقة بسبب هروبها من المنزل، عبر الفقرة السابعة من المادة 586 التي تنص على أنه «يعفى من العقاب المجني عليه الذي يثبت انه أرغم على ارتكاب أفعال معاقب عليها في القانون أو خالف شروط الإقامة أو العمل». ويرى صاغية أن ذلك «يقلب المعادلة القانونية الخاصة بالطرفين لصالح العاملة في المنزل».
ويرى صاغية انه نتيجة للقانون «لا يمكن للدولة أن تبقي على نظام الكفيل»، متوقفاً عند مسؤولية الإعلام والمجتمع المدني في مراقبة تنفيذ القانون لإيقاف جرائم الإتجار بالبشر.
وعلى صعيد التنفيذ العملي للقانون، يؤكد صاغية أنه «تجدر مراقبة كيفية تطبيقه في النيابات العامة والمحاكم، إذ يمكن البدء بملاحقات جدية لأرباب العمل على أساس معاقبة جريمة الإتجار بالبشر».
ويمكن لنصوص قانون الإتجار بالبشر أن تشكل عاملاً قوياً في ردع ممارسات أصحاب العمل، وتعديل سلوكياتهم لجهة دفع مستحقات العاملة في المنزل، واحترام حقها بساعات عمل محددة، وبإجازة أسبوعية وبالراحة خلال النهار، وبعدم تشغيلها لدى الآخرين ضمن العائلة الكبيرة، وبالتوقف عن استغلالها جنسياً أو اغتصابها، وصولاً إلى تغيير الذهنية التي تُشعر رب العمل بأنه حرٌّ في فعل ما يريده بالعاملة في منزله، وقادر على ذلك.
ويرى صاغية أنه يمكن للمحامين المناصرين لحقوق الإنسان وللجمعيات الناشطة في المجال عينه، «أن يعبّدوا الطريق أمام الاستفادة من نصوص قانون الإتجار بالبشر لحماية العاملات في المنازل، بانتظار أن يتحررن من سلطة الكفيل، ومن كل الممارسات غير المحقة المرتكبة بحقهن، بعدما تضع الدولة قانوناً خاصاً بهن».

20-year old Ethiopian domestic worker falls from 3rd floor, dies

Lebanese National News Agency reported today that in Beirut suburb Haddath (South-East of Beirut) in Debbas square, 20-year old Ethiopian domestic worker, Hana Ashalohaili, "fell" from the 3rd floor balcony of her employer's house. Her employer was Sarkis Antonios Ibrahim Boutros. She died and her body was immediately transferred to Baabda Governmental Hospital.

افاد المندوب الامني للوكالة الوطنية للاعلام الياس شاهين، انه في محلة الحدث ساحة الدباس بناية الطبيب ريشار صباغ، سقطت الاثيوبية (هنا اشالوهايلي- عشرين عاما) من منزل مخدومها سركيس انطونيوس ابراهيم بطرس من على شرفة الطابق الثالث، وما لبثت ان فارقت الحياة، ونقلت جثتها الى مستشفى بعبدا الحكومي.

عمال أجانب يحتفلون بعيدي الميلاد ورأس السنة في لبنان

عيدهم عيدان. احتفالات متنوعة لمناسبة عيد الميلاد ورأس السنة، وفرحة لا توصف لخروجهم إلى «الحرية» ليوم واحد، بعيداً عن بيوت مخدوميهم. أبناء وبناء جاليات أفرو - آسيوية مختلفة، يتجهّزون، يزينون، يحتفلون، ويبتهجون بعيد الميلاد على طرقهم الخاصة.
وتبقى لذّة العيد مختلفة بينهم، فهم، في نهاية المطاف، غرباء بعيداً عن أوطانهم، وعائلاتهم، وأطفالهم، وبيوتهم ليست هنا، إنما في النيبال وأثيوبيا وسريلانكا والفيليبين والهند، ...لو وجد بابا نويل، لكان طلبهم الأول والأخير منه هو أن يعود بهم إلى «هناك»، إلى بلادهم الأم، ولو لليلة واحدة فقط.
لكن، بما أنهم هنا، وبما أن مزلاج الشيخ ذي اللحية البيضاء لا يطير، فما العمل؟

حفل فني ساهر مع «أوجان»

سنة تلو الآخرى، استطاع أبناء بعض الجاليات، لاسيما الأثيوبية، «تنظيم صفوفها»، والتحضير لحفلات ميلادية متنوعة، تجلب الفرحة وتجمعهم في سهرات غنائية مبهجة. وهو تحديداً ما تعلن عنه البوسترات واللافتات المنتشرة في بعض أحياء النبعة وبرج حمود وكرم الزيتون والحمراء، بحيث تقدم برنامجاً ساهراً متكاملاً.
وجوه الفنانين والمغنين في الصور مجهولة بالنسبة إلى أي لبناني يمر أمام اللافتة، فلا يمنحها من اهتمامه، في حين يكاد تشاندرا، الشاب الهندي، يقفز من الفرحة أمام اللافتة التي تعلن عن حفل للمغنية «ماهي»، والمغني «أوجان»، والمغنية والعازفة «راجينا». يقول الشاب الذي يعمل في شركة للتنظيفات، إن «هؤلاء ليسوا بفنانين مشهورين، ولكن أكيد هم يعرفون أشهر أغاني رأس السنة الهندية والآسيوية. لا بد من أنهم سيغنون بلغتي، وهي أكثر ما اشتاق إليه». الحفل الذي يتحدث عنه تشاندرا ليس مخصصاً للجالية الهندية فقط، لا بل ان أبناء الجالية النيبالية هم الذيم ينظمونه، مستهدفين فئات مختلفة من أبناء الجالية الأفرو - آسيوية المقيمة في لبنان.

يسهل حفظ تاريخ الحفل الذي يقام اليوم السبت، ويعاد تقديمه في الأول من كانون الثاني 2012، أما موقع الحفل فيسجله الشاب على ورقة صغيرة، إذ من المقرر إقامته في إحدى مدارس منقطة سد البوشرية، ويبلغ سعر البطاقة للفرد الواحد 17000 ليرة لبنانية، أي ما يعادل عشرة في المئة من راتبه الشهري. سيرتادها، على الرغم من أن سعر البطاقة مكلف قليلاً بالنسبة إلى ميزانية تشاندرا، وهو قد أرسل مجموع رواتب أربعة أشهر لعائلته في الهند.
كثر سيرتادون الحفل المذكور، ولن يقتصر احتفالهم على الرقص والغناء، فتبادل الهدايا يشكل جزءاً أساسياً من عيد الميلاد. وهنا، تعتبر المهمة الأصعب والأكثر تحديا بالنسبة إلى هؤلاء العمال الذين يتقاضون رواتب متدنية جداً، بالمقارنة مع قيمة السلع في لبنان. البديل التجاري هو المتاجر المخصصة لهم، والتي تبيع منتجات بلدانهم الغذائية، ومستحضرات التجميل والكريمات، بالاضافة الى سلسلة المتاجر التي تعرف باسم «وان دولار»، وتبيع الكثير من الخزفيات والألعاب والعطور وزينة الشعر والأكسسورات، وغيرها. لكن، مع أن اسم المتجر يوحي بأن قيمة أي سلعة فيه لا تتخطى الدولار الواحد، يصعب على «أوتي» أن تجد هدية مناسبة لصديقها تقل قيمتها عن خمسة آلاف ليرة لبنانية (نحو 3 دولارات)، وهو مبلغ يضاف إلى أكثر من عشرين ألف ليرة، بدل هدايا لصديقاتها وجاراتها في الحي، وهي تعمل في سن الفيل.

تبولة وانجيرا والدورو وات

تعمل أوتي في لبنان منذ أكثر من أربع سنوات، وتعيش سباقاً مع الوقت، فلا تملك أكثر من ساعة لتنتقي هداياها، وتشتري بعض مكونات طبق أثيوبي تقليدي تشارك بواسطته بإعداد مائدة العشاء المنزلي، في منزل صديقتها في كرم الزيتون. تجدها تتلفت بحركات سريعة بحثاً عن تذكارات مناسبة يصعب انتقاؤها في المتجر المزدحم بشابات وشبان من مختلف الجاليات، يعيشون بدورهم مغامرة شبيهة.
تشرح الفتاة الأثيوبية أن عيد رأس السنة الأثيوبية لا يحل في الأول من كانون الثاني، بل في السابع منه، وفقاً للتقويم القبطي، لكن، لأسباب كثيرة، تتم «لبننة» موعد العيد بحيث يحظى أبناء الجاليات بفرصة للالتقاء والاحتفال، علماً أن الكثير من الاثيوبين يكررون الاحتفال في السابع من كانون الثاني، الذي يسمى «غنّنا».
«لبننة» العيد لا تكون فقط لجهة موعده، بل أيضا على مستوى الأطعمة التي تحضر لعشاءي الميلاد ورأس السنة، إذ تصرّ «روكشونا» على تحضير بعض أصناف المازة اللبنانية، لا سيما التبولة والحمص وأقراص الكبة المقلية. وتضاف إليها طبعاً الأطباق التقليدية في البلد الأم لروكشونا، أي بنغلادش، مثل «البنتا اليش» المكون من الأرز والسمك لمجفف، والأطباق المشبعة بالكاري والخضار المقلية، بالاضافة الى حلويات «الشوم شوم» و«الرزامالي». تقول الشابة العشرينية إنها «موعودة»، خلال عشاء رأس السنة، بتذوق أطباق تقليدية مختلفة من أثيوبيا والنيبال، لاسيما «الدورو وات» وخبز «انجيرا».
لا يكتمل عيد أي من العمال المنزليين من دون معايدات العائلة عبر الهاتف، علّه يخفف من ثقل البعد والمسافة. سؤالان أساسيان يتكرران في بداية كل اتصال في السنترالات المكتظة والمتواجدة في معظم المناطق، من برج حمود والنبعة والحمراء وصولاً الى صبرا: «هل وصلت المبالغ المادية المحولة من لبنان؟ وهل وصلت الرسائل وبعض الصور عبر البريد؟». بلغات مختلفة، يتكرر السؤالان، هنا في السنترال الصغير في الشارع المتفرع من شارع الحمراء الرئيسي، وبعدها، تكر سبحة الخبريات التي يجب أن تُنقل بأسرع وقت ممكن، كي لا ترتفع قيمة المخابرات الهاتفية.

عنصرية لا حدود لها

في جانب مظلم للأعياد، يعيش عدد من أبناء الجالية حالة مستمرة من التمييز العنصري الذي يمارسه بحقهم مواطنون لبنانيون. ويمكن القول ان تلك الممارسات ليست محمولة ولا مسموحة، كقصة ناندي التي ترويها بحزن، مكررة: «أنا مش حرامي، أنا مش حرامي». ناندي فتاة من الجالية السريلانكية، تعمل في لبنان منذ أربع سنوات، وكل ما كانت ترغب في فعله هو شراء فستان جديد لمناسبة عيد رأس السنة.. ما يصعب تحقيقه في متجر الألبسة التي دخلته ناندي منذ يومين، في منطقة برج حمود، لتنتقي فستانها. صاحبة المحل لاحقتها كظلها، تأملتها طويلاً ولم يعجبها «منظرها». تجاهلتها الشابة السريلانكية، فهي باتت معتادة على عنصرية تتفوق على نفسها من بعض اللبنانيين. اختارت ناندي ثلاثة فساتين لتقوم بتجربتها، واختيار واحد يناسبها، لكن، ما ان توجهت الى غرفة القياس، حتى هرعت اليه البائعة رافضة أن تجربها، رامية اياها بجمل عنصرية من نوع: «ما فيك تقيسهم، يا بتوسخيه يا بتسرقيهم».
لم تجب ناندي بأكثر من جملة واحدة: «أنا مش حرامي».. وقفلت خارجة من المتجر. تقول ناندي إنها لم تصدق أن مخدومتها سمحت لها أخيراً، للمرة الأولى، بمشاركة أصدقائها الاحتفال برأس السنة، وجل ما كانت تحلم به هو فستان جديد. لكن، نظراً للواقع اللبناني المريض، لم تبتع فستاناً جديداً، بل لجأت إلى إحدى صديقاتها التي تعيش وحدها في منزل صغير في كرم الزيتون، لتشكو همها وتستعين بها للتجهّز للحفل.
ليس بعيداً من المنزل المذكور، تعيش تيغست وابنة عمتها، في غرفة صغيرة لا يدخلها الكثير من الضوء. تخشى الفتاتان الاجابة عن أي سؤال، خوفاً من تشويه اعلامي سبق أن أضر بهما. تقول تيغست إنها «لم تصدق أنها أخيراً وجدت لنفسها غرفة صغيرة في هذه المنطقة، بعدما طردت من منطقة برج حمود إثر التقرير الاعلامي العنصري الذي صور العمال والمهاجرين كمفسدين». تكرر الفتاة: «نحن ما في شي نعمل، أنا غود، أنا بس بدو يُشتغل»، تقول جملتها هذه وتعود لتنهمك بتحضيرات بسيطة لعيد الميلاد، وتزيين شجرتها الصغيرة التي لا يتعدى طولها الثلاثين سنتيمتراً. شجرة صغيرة، إنما تكفيها لتحتفل بعيد الميلاد، بالحد الأدنى الممكن. الشابة السريلانكية لم تحظ يوماً بشجرة لعيد الميلاد. في منزلها في جنوب سريلانكا، اعتادت تغيست على زينة مكونة من الشرائط الورقية البرتقالية والخضراء والحمراء والبنفسجية.. ولم يكفها مدخولها يوماً لتشتري شجرة وتزينها بالطابات الحمراء اللامعة، كحال شجرتها البيروتية.
الشجرة المتمركزة تحت سقف رطب، أضيئت. واليوم، بدأت تيغست الاحتفال بعيد الميلاد.

في الإطار الحقوقي ذاته، دارت الجلسة الثانية (ترأسها الباحث القانوني كرم كرم) التي خصصت لـ«المرأة السلعة وروابط الاستغلال»، لتتخصص في الأحكام القضائية التي صدرت في قضايا العاملات في المنازل وعاملات الجنس.
وبعدما تحدث مدير منظمة «هيومن رايتس ووتش» في لبنان نديم حوري عن وجود حوالى مئتي ألف عاملة منزلية، «يوجد من بينهن 85 ألف عاملة من دون أوراق شرعية، ما يطرح فشل نظام الكفيل المعتمد في لبنان»، توقف عند الأرقام التي توصلت إليها الدراسة التي أجرتها المنظمة بالتعاون مع المحامي رولان طوق في العام الماضي. وأشار خوري إلى أن «العاملات هن خارج إطار قانون العمل (وإن كنّ محكومات وفق العقد الموحد)، ما يضعهن خارج معايير الحد الأدنى للأجور ودوام العمل وتعويض نهاية الخدمة». وقد شملت الدراسة 114 قضية، «من بينها 107 أحكام جزائية وسبعة أحكام مدنية، والباقي أمام مجلس العمل التحكيمي».
وتوقف حوري عند عقبات الوصول إلى العدالة في قضايا العاملات في المنازل، ومنها: عدم معرفة العاملات بحقوقهن وبكامل هوية رب العمل عند الادعاء عليه، ونظام الكفيل ونقص مراكز اللجوء الآمنة للعاملة، وكلفة الدعاوى وطول مدة المحاكمة، حيث تستغرق أي دعوى حوالى 24 شهراً تكون العاملة قد رحلت خلالها، مؤكداً انه «يتم البت بالدعوى اسرع عندما تكون من رب العمل على الخادمة وليس العكس».
وتفاجأ معدو الدراسة بكون معظم الدعاوى قد رفعت من قبل رب العمل على الخادمة (84 حكماً)، بينما لا يتجاوز عدد العاملات المدعيات على رب العمل العشرين حالة، وذلك بسبب الصعوبات التي تعترض العاملة المحكومة بنظام الكفيل، ومحدودية القدرة على الوقوف بوجهه.
وتبيّن الدراسة التساهل القائم في لبنان في معالجة دعاوى العاملات، «حيث لا يعاقب القانون على ضرب العاملة بشكل لا يتسبب بتعطيلها لأكثر من عشرة أيام، كأن الصفع والركل والضرب العادي ممارسات يحق لرب العمل الإقدام عليها».
إلا أن الأحكام الصادرة بحق التعنيف المؤذي، لا تبشر بكثير الخير أيضاً! إذ اقتصر الحكم في إحدى الحالات التي ضرب فيها رب عمل (وهو طبيب، للمناسبة) إحدى العاملات عنده، وأقدم على حرق عاملتين أخريين، على سجنه، ومن ثم استبدال السجن بغرامة لم تتجاوز 333 دولاراً أميركياً. في المقابل، حكمت المحاكم في سنغافورة على رب عمل ضرب خادمته بعشرين سنة سجناً، كما قضت بسجن سنغافوري آخر 12 عاماً لأنه احرق العاملة بالمكواة، بينما حكمت سيدة لبنانية بالسجن لمدة عام ونصف العام فقط، بعدما قتلت خادمتها.

Filipino workers may soon be able to return to #Lebanon

Overseas Filipino workers (OFWs) may soon be able to return to Lebanon, the Philippine Overseas Employment Administration (POEA) said Tuesday.

POEA administrator Carlos Cao Jr. disclosed in a phone interview Tuesday that the Philippine government is set to sign a new memorandum of understanding (MoU) with Lebanon next month, which may allow OFWs to go back to the Middle East country.
“The agreement will serve as a
bilateral agreement, which will allow Lebanon to comply with the requirements under Republic Act 10022,” Cao said.
Under RA 10022, the government must assure there are labor laws, bilateral agreements, ratified conventions or other concrete measures to protect the rights of OFWs in countries, where they are being deployed.
Non-compliant countries like Lebanon will be then issued a deployment ban.
However, Cao said the MoU will not lead to the immediate lifting of the deployment ban since the Department of Foreign Affairs (DFA) will still have to conduct a separate security assessment of the areas where the OFWs will be deployed.
The Philippine government earlier issued a deployment ban to Lebanon in 2006 due to the escalating tension between Israel and the Lebanese Hezbollah movement.
Coalition of Licensed Agencies for Domestic and Service Workers (CLAD) President Estrelita Hizon welcomed this development, saying this will allow OFWs to legally enter Lebanon and participate in its growing labor market.
She said since the ban took effect five years ago at least 30,000 undocumented household service workers were still able to enter and work in the Middle East country.
“The lifting of the ban augurs well for our OFWs since they will now be protected and covered with welfare benefits by the POEA and Overseas Workers Welfare Administration (OWWA),” Hizon said.
Meanwhile, the government is also mulling on issuing a partial deployment ban to Libya, which will last beyond the Christmas season.
Labor Undersecretary Danilo Cruz said in a separate interview that the Department of Foreign Affairs (DFA) has already submitted a report to the Office of the President, recommending the reduction of its security alert level.
This will then allow the POEA to deploy returning OFWs back to the North African country.
“This will lower the alert level for Lebanon and allow OFWs to return even beyond the Christmas season,” Cruz said.

Philippines: 37 domestic workers who defied deployment ban back from Lebanon

The Department of Foreign Affairs (DFA) on Thursday reminded prospective overseas Filipino workers (OFWs) to respect the total deployment ban to Lebanon and other countries.

The DFA also continued to warn Filipinos intending to work abroad to steer clear of illegal recruiters.
This was after 37 OFWs were repatriated from
Lebanon where they were employed as domestic helpers despite a ban on the deployment of OFWs there since 2007. The workers arrived in Manila on Wednesday afternoon via Qatar Airways from the Middle East.

The OFWs were not identified but the DFA said majority of them had worked in Lebanon in defiance of the total ban on sending Filipino workers to that country.

“Of the 37 repatriates, only five were documented and who arrived in Lebanon before the deployment ban in 2007,” DFA spokesperson Raul Hernandez said.

“Majority of the group escaped from their employers for abuses such as unpaid salaries, maltreatment, verbal abuse, overwork, lack of food, forcible extension of contract, illegal reduction of salary or lack of salary increase, refusal of employer to renew the worker’s legal papers, and sexual harassment,” Hernandez said.

The government paid for the OFWs’ airline tickets, using the Assistance to Nationals Fund.
Prior to their repatriation, 36 of the returnees were sheltered by the Filipino Workers Resource Center, a facility attached to the Philippine Embassy in Beirut. The 37th was detained at Lebanon Immigration’s Retention Center in Adlieh, Beirut.

In 2007, the government declared a ban on the deployment of OFWs to Lebanon due to the security situation and inadequate legal protection for workers in that country.

Despite the ban, many Filipinos still managed to travel to Lebanon and work there illegally, circumventing the restriction by first flying to a third country before proceeding to Beirut, often with the help of unscrupulous recruiters.

Last month, 29 illegal OFWs were repatriated from Lebanon.

Preethi Nallu and Henrik Anderson 30 Nov 2011 Beirut, Lebanon - Lebanon is home to 1.2m foreign migrant workers out of which the domestic migrant worker (DMW) population is estimated at 400,000 and almost all female. The incremental growth in domestic workers has been due to a combination of Lebanese views on social status and feminism where household chores are viewed as lowly and unworthy of middle and upper middle class wives
. As these female domestic maids live in the houses of employers, they have inevitably become the most vulnerable demographic amongst foreign workers, invisible to the outside world and perceptible to abuse.

Where are the activists?
In 1998, academic Lina Abu-Habib published a paper in which she highlighted the dearth of civil society movements concerned with migrant rights in Lebanon. She noted that within the Lebanese NGO community and women's groups, there was a general lack of interest in the topic. 'They came here of their own free will', 'they would have starved to death in their own countries', and 'they're stealing jobs away from Lebanese' were some of the recurring sentiments that Lina encountered.
The country was still recovering from both the mental and physical after-effects of the civil war years resulting in indifference towards the migrant population. Large parts of the country still lay in ruins and former PM Rafiq Hariri's economic revitalising schemes were yet to take root in society. To put it bluntly, the Lebanese was preoccupied with more pressing issues to be concerned with their new labour force.
More than a decade later, apathy towards the plight of these workers persists where Bourgeoisie Lebanese often carry an unapologetic attitude in relation to domestic workers imported in large numbers because they emanate from countries with stark poverty. Lebanese employers often manage to ignore their maids being restricted to the kitchen, even outside working hours. But then again, in cases where these maids live in the houses of the employers, there are often no fixed working hours and the chores continue from dawn to dusk at the whims and commands of those paying. In this sense the maid becomes a purchased commodity from which the purchaser seeks maximum use.
Despite a handful of initiatives and organisations, the NGO sector and academic research still lack support from legal frameworks and government led initiatives to corroborate their efforts.

Empowering migrants
Imagine two striking Asian women, on screen, in their summer clothes and oversized shades hurrying towards the beach talking excitedly with interludes of animated gesturing. Mid stride, they come to a sudden halt. An invisible barrier seems to stop them at the steps leading to a private beach in Beirut. The frame freezes and a text appears on the screen. It reads " 56 per cent of private beaches limit access for migrant workers".
This is a scene from the latest video campaign by the Migrant Workers Task Force (MWTF), the most active grassroots movement one can presently find in Beirut. The initiative was started by expatriate NGO workers who could not help noticing the obvious mistreatment of migrant workers, especially of domestic maids.
There is indeed an invisible barrier that delineates a clear social distinction where an outside 'migrant class' is separated from mainstream Lebanese society. Alex Shams, co-founder of MWTF, could not help noticing this rampant problem.
"It seemed like this massive elephant in the room, in the sense that we have this large group of people who are systematically denied their legal human and workers' rights as well as systematically abused by a wide cross section of members of Lebanese society, and yet no one seems to be talking about it," he explains.
The mission of the organisation, still in its nascent phase, is a "direct and individual" approach to the endemic mistreatment of migrants workers in Lebanon. But, MWTF is only able to help those workers who are permitted to step out of the houses to which they are assigned. The unfortunate reality is that 85 per cent of MDWs do not get a single day off and hence become invisible victims.
In Alex's experience even well educated, liberal people he knew, thought that "the Geneva Convention stopped at their front door and that locking up a woman in their house for two years was a normal or justifiable act,"

Access to justice
HRW's latest report titled 'Without Protection' chronicled 114 cases of legal complaints by migrant workers in Lebanon but did not find one single case in which the employer who had confiscated the employee's passport, confined the person within the house or denied basics such as food, was legally charged with a crime. The report also confirms that the protracted legal procedures, accompanied by "lack of judicial support for the workers, fear of counter-charges, being held in detention and restrictive visa policies" create an impossible situation for the MDWs.
Such research is evidence of a clear lack of commitment from government authorities, recruiters and employers towards changing the status quo of migrant workers socially and legally. This sense of apathy has clearly permeated the society and the system.

The vicious cycle
Based on prevalent experiences reported by abused workers, this is the typical chronology of the vicious cycle that entraps domestic help entering Lebanon. The process of systematic discrimination starts at the port of entry, where immigration authorities hand over the worker to the sponsoring 'owner' who is then advised to withhold the passport of the worker as a precautionary measure. If at any point during the contractual period, the worker is faced with issues such a non-payment of wages, abuse or inhumane treatment, he or she would usually take it up with the employer who is then free to terminate the contract without legal repercussions. In cases where the worker is able to file a complaint against the employer with the police, the authorities are required to conduct an investigation, the average response time from law enforcement agencies has been 21 days. In rare instances where the case reaches Lebanese courts, the worker is faced with a protracted trial, expensive fees and little to no support from the state or the local recruitment agencies that brought the worker into the country.
At any stage of this cycle the foreign worker's permit to remain in the country can be made null and void on the employer's sole discretion due to a Kefala or sponsorship system that bestows disproportionate amount of power to the sponsor. 'Sitting on the bench' is not a legal option for workers who are in the process of challenging their employers.

'Kefala' - Modern day slavery?
The Kefala system adopted by some of the largest receivers of migrant workers in the Gulf states and Lebanon, has become synonymous with 'modern-day slavery' amongst human rights groups. Although the manner in which the system is implemented has certainly created a situation of inequity in terms of a just legal recourse for the migrant workers, it is not the system itself that is inherently racist or even unique to the Middle East. Most immigrations schemes around the world are based on the sponsor, who is usually the citizen, in need of services from a foreign worker.
The Kefala system, an official term used in Lebanon and other Middle Eastern countries, is a visa scheme similar to that of temporary workers in most countries across the world. Under this system, the work permit of the MDWs is fully reliant on the sponsor/employer (kafeel) with extremely limited to no options for the migrant worker to change jobs whilst being inside the country. "Those who leave their sponsor/employer without permission from both the sponsor and the government (and for whatever reason) are immediately classified as illegal aliens and are thus subject to arrest, detention (imprisonment) and deportation."
Research by Ray Jureidini at The Centre for Migration and Refugee Studies claims that 52 per cent of MDWs are verbally abused, 14 per cent physically abused, 7 per cent sexually violated. These figures are shockingly high and underline the proliferated nature of violations.

Legislation first or change in attitude?
"There is a systemic arrangement that creates a structural vulnerability for migrant domestic workers in the Middle East, and as such it is a human rights issue".
Jureidini's observation, when coupled the inherent racism that has permeated a majority of Lebanese households, calls for urgent action by local civil society and reform in the domestic legal system. The conundrum is whether societal views have shaped the current judicial process that fails to protect non-Lebanese workers or if the lack of legislation has encouraged a glaring lack of response from society and its individuals. What should lead, what should follow and what is most plausible in practice?
A viable start would be for the Lebanese courts to implement the "deprivation of liberty" act present in their penal code (also known as Hajez Huriyat) towards currently normalised practices such as confiscation of passport and restriction of movement of the worker. Protecting the migrant workers under whistle-blowers acts which enable them to voice complaints of non-payment without having to leave the country is another imminently needed legislation. As part of the next step, Lebanon could look towards neighbours such as Jordan that have incorporated domestic workers' rights into their national labour laws that guarantee basics rights such as 10-hour work days and direct wage payments. Others, such as Singapore, are undertaking measures to monitor abuse of MDWs and publicise cases that reach the courts. As pointed out consistently by research and reports, reforming an inherently abusive sponsorship system can be accomplished through quick and simplified resolution mechanisms. But this requires initiative from the government, change in attitude from Lebanese society, at large, and mobilisation by citizens to remedy their non-Lebanese residents' grievances.

Why should the Lebanese care?
To begin with, understanding that domestic work does not constitute a violation of the rights of an emancipated woman is important for feminism to evolve in Lebanese society and for a more pragmatic introspection in a society where even middle class families have 'servants' because it is signifies an elevated social status. Reality is that many of these roles can and should be filled by citizens who remain unemployed. Certainly, the 20 per cent of the Lebanese population that lives below the poverty line could use such employment.
In the long term, as generations of foreign domestic workers continue to arrive and manage to escape from their contracts and their employers due to rampant abuse, it could lead to formation of disparate, isolated migrant communities that become microcosms within Lebanese society. This would add to the socio-psychological dysfunctionality that already exists in Palestinian camps of Lebanon, where illegal migrants, Roma and other pariah communities have increasingly sought refuge, creating ghettos and squats in the areas. Adding to this population without representation would only increase the woes of the state of Lebanon that already struggles to provide social services to its registered citizens. In a country with a population of just over 4 million, a disgruntled demographic of over 400,000 presents a sizeable issue that needs immediate attention.

They condemned the racist media coverage of Lebanese TV (i.e. Murr TV owned by Jihad/Jyad Murr). They also condemned the arbitrary detention that migrants were victims of.
The following is the press release.

نجتمع اليوم ممثلين وممثلات عن الجاليات الأفريقية والأسيوية في لبنان لنوضح ملابسات الأحداث المؤسفة التي برزت مؤخرا في لبنان ذات الطابع العنصري التي تعرض لها المهاجرون في لبنان من التابعيات الأفريقية والأسيوية من خرق لحقوقهم من توقيفات عشوائية وترحيل قسري ومضايقات يومية في منطقة برج حمود/النبعة/الدورة، هذه الأحداث التي تلت تقرير إحدى المحطات اللبنانية.

كما نحن هنا أولا وأخيرا لشرح وجهة نظرنا بلساننا وببيان صادر عن جاليتنا إذا مللنا التصريحات التي تصدر عنا من دون إستشارتنا أو حتى الأخذ بوجهة نظرنا كأننا لا نملك القدرة على التعبير عن أنفسنا فنحن في النهاية مواطنين ومواطنات مهاجرين/ات من بلاد ذات سيادة وإستقلال وعضو في الأمم المتحدة وعلى علاقة سياسية وإقتصادية وتجارية وديبلوماسية بلبنان.

إذن وحتى لا نطيل عليكم و لمعرفتنا أن الريبورتاج سيكون على أحسن تقدير مدته دقيقتان سنلخص الأحداث بنقاط سريعة ونفتح المجال أمامكم للأسئلة والأجوبة.
أولا - نحن ندين بشدة اللغة والمقاربة العنصرية التي إعتمدها تقرير بعض الوسائل الإعلامية اللبنانية من تعميم وإسقاط عنصري فوقي على الأجانب/يات والعمال/عاملات المهاجرين/ات إلى لبنان على أنهم أعضاء عصابات ومروجي مخدرات وعاملات جنسيات.
ثانيا - نحن نوضح للرأي العام اللبناني وللقوى المولجة بحفظ الأمن اللبناني أننا جئنا لهذا البلد لنعمل بكرامتنا وقطعنا آلاف الأميال لنؤمن لقمة عيشنا ولم ولن نأتي للبنان إلا لأن للشعب اللبناني سوق وحاجة إقتصادية وإجتماعية لخدماتنا التي نؤديها على أكمل من وجه وعندما ينضب وينعدم هذا السوق سترونا نهاجر لبلد آخر لنؤمن قوت يومنا ومستقبل أولادنا فلا مصلحة لنا لا اليوم ولا غدا بإثارة المشاكل أو التعدي على أحد أو إقلاق الأمن.
ثالثا - نحن ندين الإعتقالات التعسفية التي تطال الجميع ومع تفهمنا أن السلطات اللبنانية عليها توقيف من لا يحمل إقامة شرعية على الأراضي اللبنانية لكن ما يقلقنا هو سياسة الإرهاب التي ترافق الإعتقال والضرب والإهانة الذي يلازم هذا الإعتقال كأنه فولكلور ،و أيضاً ندين الإعتقال المؤقت لِحَمَلة الإقامات الشرعيّة.
كما ندين الشتائم والنعوت العنصرية والمعاملة اللاحضارية التي يعامل بها المعتقل/ة أثناء فترة التوقيف مما في ذلك أولا خرق أساسي لحقوق الإنسان وثانيا إهانة لكرامات البشر.
رابعا - نحن نناشد القوى السياسية الفاعلة في مناطق برج حمود والنبعة والدورة حماية الأجانب/يات من الإعتدائات اليومية من سلب وضرب وترحيلات قسرية من البيوت وتحرش جنسي الذي تتعرض له الجاليات الأجنبية ونذكر الِقوى السياسيّة أنها كانت يوما ما في نفس الموقف وكافحت لتخرج منه ونحن نحيي نضالها الإجتماعي والسياسي ونعتبره مثالا يحتذى به لذا نرى أنه من واجبها حمايتنا من أي خطر نتعرض له من منطلق التعاضد.
كما نناشد الجميع في المناطق القيام بواجبها الأخلاقي المباشر من حماية الأجانب في وجه أي خرق لحقوقهم والتعدي عليهم.
خامسا - نذكر المجتمع المحلي أن الأجانب يساهمون بشكل مباشر في الإنماء الإقتصادي للمنطقة وترحيلهم وترهيبهم يؤثر على أعمال المجتمع المحلي وأرزاقهم وشهدنا في الأيام الأخيرة إنخفاض رهيب في الأعمال ورقم المبيعات.
سادسا - نذكر المجتمع اللبناني أنه كما نحن نتواجد على الأراضي اللبنانية هم أيضا موجودون في بلدنا ويستحصلون على جنسية بلدنا ولهم مصالح إقتصادية ويعيشون بيننا وقد أمضوا حياتهم في المهجر وقد تلقوا أحسن المعاملة كمواطنيين/ات لهم نفس الحقوق التي لدينا كمواطننين/ات في بلدنا الأمر الذي لم نلقه في المقابل في لبنان بل العكس عوملنا كأنصاف بشر وتعرضنا لأسوأ أنواع التمييز العنصري والجندري على المستوى الإجتماعي والإقتصادي.
سابعا - العمل ليس صفة بل هو مهنة لذا نحن نمارس مهننا بكل فخر وكرامة والعمل ليس عيبا بل العيب هو الممارسات اللأخلاقية التي نتعرض لها من عدم دفع الراتب لأشهر والتحرش الجنسي والإعتدائات الجسدية والمعاملات التي نلقاها من المجتمع والقوى الأمنية.
ثامنا - آخرا وليس أخيرا نحن نؤكد على تمسكنا بحقوقنا الكاملة تحت سقف القانون مع تعليقاتنا الكثيرة على قانون العمل وعقد العمل.
ونؤكد أننا هنا لنعمل ونساهم في إقتصاد وتنوع ثقافة لبنان بكل فخر.
ونهيب بالقوى الأمنية بالقيام بواجباتها على أكمل وجه إن كان من جهة حمايتنا أو الإستماع إلى شكوانا وبالمجتمع اللبناني بشكل عام للوقوف إلى جانبنا بوجه الحملة العنصرية التي نتعرض لها.

Dutch pastor reaches out to domestic workers

BEIRUT: Between the poorest of the poor is where Father Theo Vlugt feels at home. “My Big Boss says in the Bible: What you have done to the poorest of my people, you have done to me!” he points out, in his native Amsterdam accent.

Already in his 80s, Father Theo is still going strong with a whole life of selfless service to the poor over 60 years as a Jesuit and half a century as a Catholic priest.

“Every day I am happy that I can do this job,” he says, eyes sparkling, at the celebration of his jubilee at the premises of his Asian-African Welfare Center, next to the church of St. Joseph in Ashrafieh, where Father Theo bases his efforts to assist migrant domestic workers in Lebanon.

“These young ladies, they are like
family to me. But the problems are overwhelming. These housemaids from the Philippines, Sri Lanka, Nepal, Bangladesh, Ethiopia and Nigeria all work in the houses of well-to-do Lebanese families, but are widely looked down upon.

“They are despised, socially neglected, they are the rejected cohabitants of the Arab world. Horribly discriminated against, and taken advantage of, often mistreated and beaten, sometimes even worse. Every week one of them jumps from a Beirut apartment tower. One every week!”

Father Theo says every now and then he is invited for a religious ceremony to one of those Lebanese families’ homes, for instance to lead prayers when there is something to be celebrated, or commemorated.

“Then I always ask: is everybody present? Yes, everybody is here! And then I repeat: Really is everyone here? Yes, yes, abouna, everybody is present. But then, after a while, the Ethiopian maid enters the room with the coffees. That is when I do my little theatrical act. I don’t say a word, but I react most surprised by pulling a face like: I thought you just assured me that everybody in the house was present! Where does she come from, all of a sudden? She’s a Christian girl, doesn’t she count?

“Then you can see their faces looking at each other: Is the abouna now telling us that our maid is also part of our family?”

Jesuit Theo never has a holiday, he works day and night, and every weekend. As a member of “Heaven’s ground staff,” as he calls himself, he often works odd hours, the phone calls never stop.

During the daytime he can often be found in the welfare center for immigrant workers near St. Joseph University, where free courses are provided for maids, who might want to become a nurse, or work in a kindergarten.

In between Theo often visits the prison, where many maids are held after they have been accused of theft. The sad reality is that all too often maids are being handed over to the police by the families they have worked for and who, by doing so, try to escape from payment of their due salaries and the repatriation bill which according to the contract has to be provided by the employer.

“In nearly all these cases nothing has been stolen. Very often the Madame of the house has put a piece of jewelry in the luggage of the maid. The police know they are being cheated,” claims Father Theo.

“It is very difficult to prove there never was any theft. The maid is put in prison during the investigation – that is the law. This often leads to deportation. In prison there are also many runaway maids, the Beirut police are hunting them in the streets, but the good thing is they are safe in prison. There, at least, they are not dragged into prostitution. In Beirut the sharks are everywhere on the lookout.”

“Of course there are also families where things are fine and where these girls are welcomed in a very friendly way. I estimate that to be some 35 percent of all cases. Thus it can happen that the whole enterprise is a success for all parties involved, the girl gets a free day every week plus the agreed salary,” says Father Theo. “But unfortunately this is not always the case.

“These poor Asian and African girls come to the Arab countries to make some money. At home they have children or other little brothers who still have to go to school. Or the parents are ill and somebody has to pay the medical bills. That is why they are here. In their poor home country they are being recruited by organizations that promise them a good salary and a free day every week.

“I always say: They do not come, they are being brought. And after that they are being exploited. Immediately after their arrival they have to hand in their passports, they are often not even allowed to have contact with their compatriots, sometimes they are totally isolated, they are in fact prisoners, have to sleep in a room that really is a cupboard and they have to wait and see if they get something to eat.

“I know of situations where girls get pregnant by their employer, or his son, and then suddenly fall down from the ninth floor balcony while window cleaning. So sad, you know, this careless girl: She accidentally fell to her death!”

Often girls flee to Father Theo’s welfare center, or he gets a phone call to come and collect a runaway maid. Sometimes the diplomatic mission of the home country is alerted, the Philippines Embassy in Beirut has a special shelter in the basement which is constantly occupied by runaway maids.

“Recently we had a prayer service there,” says Father Theo. “That day some 30 girls were flown home. Those are very special moments.”

Theo has been an immigrant pastor for 10 years. Doesn’t he ever want to return to his home country, to the Netherlands? “My country is here, my country is the Lebanon. I would not know what to do in Holland,” he says.

“The best moment of my visits to Holland is always when the plane that takes me back to Lebanon touches down in Beirut. This is my home, here is my mission.”

Migrant community leaders press conference to respond to Bourj Hammoud "events"

New TV's 8 o'clock news feature hereinafter stigmatizes the latest rise in racism in Bourj Hammoud and Dora, and mentions racist TV reports as one of the causes for these developments (without naming MTV directly, knowing that the latter's 8'oclock news report drew a lot of criticism last month). Police arrest 4 over killing of domestic worker

TRIPOLI, Lebanon: Police arrested Monday four men for allegedly killing a Bangladeshi domestic worker whose body was found in a cave in the Tripoli city of Mina late September.

The Internal Security Forces arrested three Lebanese and one Palestinian were arrested on charges of killing Bangladeshi domestic worker, Yegekha Baten Niah, whose body was found in a cave near the sea in Mina.

The four suspects confessed to
the crime claiming to have been under the influence of drugs which they took after mixing them with alcohol.

There has also been talk that drugs are rampant among youths in the city of Mina in light of the absence of a police force due to a shortage in personnel.

The men were arrested and put in jail following at the request of Prosecutor General in the North, Omar Hamza.

الخادمات في لبنان.. عبودية حديثة

حالة وفاة كل أسبوع، هذا هو معدل وفيات خادمات المنازل في لبنان، اما بالانتحار أو أثناء محاولة الهروب من السجن المنزلي. وفقاً لمنظمات حقوقية فإن ما يدفع هؤلاء النسوة للمخاطرة بحياتهن، تكمن في أساليب سوء المعاملة والعزلة المفروضة عليهن من قبل المخدومين.

هذا الأسبوع زارت المقررة الخاصة في الأمم المتحدة، جولنارا شاهينيان، لبنان لدفع الحكومة لاتخاذ مبادرات ملموسة لحماية الخادمات، ومنع تعرضهن لسوء المعاملة. وتعتبر السيدة شاهينيان أول مقررة تعينها الأمم المتحدة لمراقبة الأشكال الحديثة من العبودية. وهو تطور إيجابي على حد قول السيد نديم حوري، مدير مكتب بيروت لمنظمة مراقبة حقوق الإنسان (هيومان رايتس ووتش): "هذه خطوة إيجابية. نأمل أن تؤدي إلى تحقيق الإصلاحات الضرورية. بدأ الناس يعترفون بوجود اشكال حديثة من العبودية في لبنان. لم يعد الأمر سراً."

العزلة

أصبحت الخدمة المنزلية ظاهرى شائعة في لبنان. كثيراً ما ترى فتيات آسيويات يدفعن عربة التسوق أمام "المدام" في المتاجر الكبيرة، وفتيات إفريقيات يحملن حقائب كبيرة، وعدة السباحة على الساحل. تذهب التقديرات إلى أن الاسر اللبنانية تشغّل حوالي 200 ألف خادمة منزلية، تأتي غالبيتهن من الفلبين وسريلانكا واثيوبيا. أغلبية هذه الفتيات هن صغيرا في السنّ، يتركن أهاليهن، ويأتين للخدمة والعيش في مع اسر لبنانية لم يعرفنهم من قبل، مقابل أجر شهري بنعدل 150 دولار في الشهر. ويصبح المخدوم هو أيضاً الضامن القانوني لهن، مما يضيق من حرية حركتهن في البلد.

عجز القوانين

النظام القانوني اللبناني عاجز عن محاسبة المخدومين عندما ينتهكون الحقوق الاساسية للخادمات، هذه هي الخلاصة التي توصل لها تقرير منظمة هيومان رايتس ووتش السنة الماضية. وقد درس التقرير أكثر من مائة حكم صادر عن القضاء اللبناني في قضايا تتعلق بالخدمة المنزلية. وجاء في التقرير أن هناك الكثير من العقبات التي تجعل الخادمات يترددن كثيراً في إبلاغ السلطات عما يتعرضن له من إساءات. وحتى عندما تكون الاتهامات موثقة فإن الشرطة والسلطات القضائية لا تأخذ تتعامل معها بجدية.

وحسب السيد نديم حوري فإن "غض النظر عن الانتهاكات التي تتعرض لها الخادمات يجعل الشرطة والسلطة القضائية متواطئين في الانتهاكات المستمرة من قبل المخدومين ضد فئة ضعيفة." على حد قوله عند إصدار التقرير العام الماضي، مضيفاً إن "حبس شخص ما أو صفعه هو جريمة، بغض النظر عن هوية الضحية."

عقوبات مخففة

لم تعثر منظمة هيومان رايتس ووتش على مثال واحد في القضايا الـ 114 التي درستها، عوقب فيه أحد المخدومين على احتجاز خادمة داخل المنزل، أو مصادرة جواز سفرها، أو منع الطعام عنها، بالرغم من أن هذه الانتهاكات شائعة إلى حد كبير. وحتى عندما أصدرت المحاكم عقوبات بشأن حالات تعرضت فيها الخادمات للضرب، فإن الأمر ظل محدوداً بحالات نادرة، وكانت العقوبات مخففة.

أظهرت عدة دراسات قامت بها منظمات حقوقية ارتفاع نسبة الوفيات في وسط خادمات المنازل. والمقابلات التي أجرتها منظمة "هيومان رايتس ووتش" اشرت أيضاً أن الضغوط المالية والعمل الشاق، إلى جانب الإساءات والانتهاكات، هي ما ما يفسر ارتفاع معدل الوفيات.

Legislation to protect some 200,000 domestic workers in Lebanon should be enacted by the government, said the UN’s first special rapporteur on contemporary slavery, Gulnara Shahinian.

“Migrant domestic workers in Lebanon are legally invisible which makes them acutely vulnerable to domestic servitude,” said the UN expert in Beirut on Monday, at the end of her first visit to the country. “The domestic worker is required to live in the employer’s
household, faces racial and gender discrimination and is deprived of the necessary legal protection to safeguard his or her rights.”

Shahinian urged the Lebanese authorities to ensure that domestic workers obtain legal protection and have prompt access to remedies and justice. Also that employers are aware of their obligations when recruiting someone. She warned that without legal protection some of the workers end up living in domestic servitude, under absolute control and with dependency on their employers through economic exploitation and physical, psychological and sexual abuse.

Cultural bondage
Shahinian met with government officials, NGOs, religious groups and victims who shared their stories with her, while in Lebanon. “Forced labour and confinement to the house seem common problems. Irrespective of what people think, these workers have the right to movement,” she said. “I met with women who had been forced to work long hours without any remuneration or valid contract, physically and sexually abused and morally harassed by constantly being insulted and belittled,” said Shahinian who noticed that there are also many cultural misunderstandings. “Some of the girls told me they don’t get food. When I asked what they meant by that, it turned out the employer wouldn’t give them rice three times a day. Many Asian people are used to that. They got other food but no rice and so they felt they didn’t eat. Therefore it is important that countries of origin also provide the workers with information and orientation.”

Languishing law
A national steering committee, set up to address the issues domestic workers face, has succeeded in developing a standard unified contract and a new draft law. “This law has been in its drafting stage for the past three years and it is now time that it is made a priority by the government. The law needs to balance the rights and obligations of both the employer and employee. It also needs to explicitly guarantee that migrant domestic workers are allowed to keep their passports, have freedom of movement, a day off outside the employers’ house, adequate private lodging and fair wages,” Shahinian said. She added that once the laws are in place, monitoring and implementation will be the big issue.

No blame
This is the first time she visits the Arab region. Gulf countries are high up on her list. “My mandate is not financed. I applied to visit many countries but I receive many rejections. It is not easy; many countries think that inviting me means they confirm they have slavery,” says Shahinian. She stressed she was truly impressed by the positive steps taken by the Lebanese government. “Country visits are the beginning of a long-term cooperation with a state. I felt a real commitment to change here,” says the expert and adds that she feels aggressive measures don’t work. “I didn’t come here to blame but to establish a partnership.”

International crime?
As far as Shahinian is concerned, domestic servitude could become an international crime. “Domestic workers that are trafficked, that might become an international crime. For now domestic servitude is a crime, but not internationally,” concludes the lawyer with extensive experience as a consultant for various UN, EU, Council of Europe, OSCE and government bodies on children’s rights, gender, migration and trafficking.

■ هل هناك وعي كافٍ لطبيعة الولاية التي منحت لك من الأمم المتحدة كمقرّرة خاصة معنية بالرق المعاصر؟

ـــــ لا فهم مشتركاً لما يعدّ أشكالاً معاصرة للرق. فرغم أن الكثير من المنظمات غير الحكومية والوكالات التابعة للأمم المتحدة تعمل في قضايا مثل البغاء القسري والعمل القسري اللذين يعدّان رقاً أو ممارسات شبيهة بالرق، يرى عدد قليل منها أن هذه المسائل تعدّ رقاً.

■ ما هي طبيعة زيارتك للبنان؟ وماذا سينتج منها؟

ـــــ أشكر الحكومة اللبنانية التي وجهت إليّ دعوة لزيارة لبنان عام ٢٠٠٩. لكن الظروف لم تسمح بأن أقوم بهذه الزيارة في حينه. كذلك فإنني أرحّب بموافقة لبنان على توصية المراجعة الدورية الشاملة في مجلس حقوق الإنسان عام ٢٠١٠ بتوجيه دعوة مفتوحة ودائمة إلى جميع المقرّرين الخاصين في الأمم المتحدة لزيارة لبنان من دون دعوات مسبقة، وهذا يدلّ على أن هناك وعياً لطبيعة عملنا والدور الذي نؤديه لتحسين واقع حقوق الإنسان في البلدان التي نزورها.
مثّلت الزيارة فرصة استثنائية للقاء الهيئات الحكومية ونشطاء حقوق الإنسان وهيئات المجتمع المدني لكتابة تقرير سيقدّم إلى مجلس حقوق الإنسان في الدورة التي ستعقد في أيلول ٢٠١٢. لقد زرت العديد من البلدان منذ بدء ولايتي عام ٢٠٠٨، وتوصيتي الأهم التي سيتضمنها التقرير تتعلق بضرورة توفير حماية جدية لأكثر من ٢٠٠ ألف عاملة في الخدمة المنزلية. وبغياب هذه الحماية القانونية، يعيش عدد كبير من العاملات في ظروف عبودية. والعبودية تعني أن الفرد مجبر من طريق الإكراه المادي أو المعنوي على العمل من دون أي مكافأة مالية حقيقية، ومحروم الحرية ويعيش في حالة تتنافى مع الكرامة الإنسانية. وتتعرض العاملات للعمل القسري بسبب طبيعة عملهن التي لا توفر الحماية، والعلاقة ذات

الطابع الشخصي للغاية بين العامل وربّ عمله وبسبب الوضع القانوني غير المضمون، ويجري العمل في منزل الأسرة الخاص ويضطر العامل إلى اللجوء لوسائل خفية للاتصال بالعالم الخارجي، المستبعد عادة من المكان الذي يعمل فيه العامل. لقد التقيت بنساء في مراكز إيواء تعرّضن للعنف والاغتصاب وأجبرن على العمل لساعات متواصلة، وتعرضن للشتم والتحقير. للأسف، حلقة الإساءة تبدأ من الوكالات التي تستقدمهن، ولاحقاً في منازل الأسر التي يعملن فيها. هذا الوضع غير مقبول ويجب أن يتوقف.

■ كيف تقوّمين الخطوات التي تقوم بها الحكومة اللبنانية؟

ـــــ لقد اطلعت على مشروع قانون العمل المنزلي الذي أعدّته وزارة العمل وأُبلغت بقرب التصديق على هذا القانون. وكذلك اطلعت على الإجراءات التي يتخذها الأمن العام في المطار وفي مراكز الحجز وحصلت على ضمانات بتحسين ظروفها. كذلك اطلعت على عقد العمل المشترك الذي اتفق عليه. هذه الخطوات مهمة ونرحب بها، لكن المطلوب أساساً توفير أعلى درجات الحماية القانونية، فمن غير المقبول اعتبار العاملة التي هربت من منزل مستخدميها بسبب سوء المعاملة خارجة عن القانون. الحل الأمثل برأيي هو في تخيير العاملة بين البقاء في المنزل والمكوث في بيت مستقل، وهذا الأمر يخفف أعباءً كبيرة على الطرفين ويعطي الحرية المقرونة بالمسؤولية الشخصية للعاملة. دول أميركا اللاتينية تطبق هذا الأمر، أما في الشرق الأوسط، فيمثّل نظام الكفالة عائقاً كبيراً أمام تمتع العاملات بحقوقهن الأساسية التي كفلتها الشرعة الدولية لحقوق الإنسان والاتفاقيات الدولية الأساسية، ولا سيما الاتفاقية الخاصة بالرق لعام ١٩٢٦ واتفاقية حظر الاتجار بالأشخاص، وبروتوكول منع ومعاقبة الاتجار بالأشخاص وخاصة النساء والأطفال.
انضم لبنان إلى جميع هذه الاتفاقيات، ووقّعت الحكومة أخيراً الاتفاقية الخاصة بالعمالة المنزلية التي أبصرت النور في حزيران الماضي، وهذه الاتفاقية وغيرها من اتفاقيات منظمة العمل الدولي تسهم في القضاء على العمل القسري، لكن المطلوب قوانين وطنية والتزام تطبيقها. وبديهي القول إن هناك مسؤولية كبيرة على حكومات البلدان المرسلة للعمالة، وأنا أدعوها إلى عقد اتفاقات ثنائية مع الحكومة اللبنانية وتدريب العاملات على حقوقهن وعلى ثقافة البلد الذي سيعملن فيه، وهذا بديل تلقائي للإجراءات السلبية التي تجري من طرف واحد عبر منع العاملات من السفر إلى لبنان، ليتبين أنهن يصلن بأعداد كبيرة عبر الانتقال من بلد إلى آخر في ظروف بالغة الصعوبة.

■ ماذا عن عنصرية المجتمع اللبناني؟ هل لمست هذا الأمر؟

ـــــ أقترح أن تتضمن المناهج الدراسية دروساً في عدم التمييز. هذه ثقافة يجب أن تعمّم للأجيال الصاعدة. أمر آخر أقترحه على الحكومة اللبنانية، هو أن تقوم وزارة الشؤون الاجتماعية عبر خبير اجتماعي بدور بديل من المفتش الذي يمكن أن ترسله الوكالة الخاصة أو الأمن العام أو وزارة العمل؛ لأني أعتقد أن غياب الشؤون الاجتماعية هو سبب غياب الحماية الاجتماعية للعاملات، وهذه ثغرة آمل معالجتها في المستقبل.

مناضلة نسوية

تسلمت غولنارا شاهينيان مهمتها كمقرّرة أممية معنية بالأشكال المعاصرة للعبودية في عام 2008، وهي محامية ذات خبرة واسعة، لكونها مستشارة للأمم المتحدة والاتحاد الأوروبي. عملت خبيرة في مجال الاتجار بالمخدرات لدى منظّمة الأمن والتعاون في أوروبا، وهي نائبة الرئيس المنتخب للجنة المتخصّصة في مكافحة الاتجار بالبشر المنبثقة من مجلس أوروبا. ترأسّت اتحاد النساء الأرمنيات، وشغلت عدة مناصب حكومية في مجلس مدينة يريفان.

UN Special Rapporteur on Contemporary Forms of Slavery to government: Enact legislation to protect the 200,000 domestic workers

On 17 October 2011, I attendedthe meeting of UN Special Rapporteur on Contemporary forms of Slavery, Ms.Gulnara Shahinian, at the OHCHR in Beirut. She was briefing civil societymembers on her findings and recommendations. The following are some pointsraised during the meeting. The news release follows.

Some of Ms. Shahinian’s talkingpoints:

We need a National Plan of Actionwith dedicated government funding.
There is a responsibility forsending country, to prepare the ground for avoiding tension when the workerarrives to Lebanon.
But this is not enough. Ms.Shahinian recommended that in the first month of presence in Lebanon, there isa need for one month of reconciling where the migrant workers discoversLebanon, the culture and the language.
Prevention: we need educationalprograms for all government entities where MDWs apply for assistance or for documents.
We need programs on anti-racism.We need to introduce special lessons for schools for children who are part ofthe family and are in touch with MDWs.
Ms. Shahinian was for a dedicatedlegislation outside of labor law.
The unified contract requiresenforcement, and then amendment to adapt to the needs of the domestic worker.
I recommend that domestic workershave monthly private interviews with their agency; to go out of the house forthat interview.
We need special consulting forthe families, a social worker who talk
The visa should not be tied towork. Extended stay by one or two months is important, after termination ofcontract. To be able to seek new jobs.
An agency should be establishedother than the General Security to receive complaints and play a role that theGeneral Security cannot play because it is a law enforcement agency.
We need a hotline which isworking (we have one which is not functioning).
Safe environment for migrantdomestic workers children should be provided.

There was no suggestion toabolish the sponsorship system because, as Ms. Shahinian indicated, she did not have timeto explore the alternatives to the sponsorship system.

Next step foreseen, Ms. Shahinian willwrite the report and share it with the government for feedback. Report due tobe submitted to the UN Human Right Council in June 2012, and is to be discussed inSeptember 2012.

Feedback by some participants:

The day off allowed by the newcontracts is “day off” according to labor law, and does not stipulate anoptional “day off” which takes into consideration that the employer’s home isthe domestic worker’s home.
The Notary are not reading theunified contract to the Lebanese, because it cannot be changed. The Lebaneseare not aware of the content of the contract and the rights of the domesticworker!
We need to replace the KafalaSponsorship system with a contract, along with a renting contract with theemployer should the MDW! But Ms. Shahinian asked if a migrant domestic workerscan afford renting a place if they get a “full” salary and want to live outsideof the employer’s house.
There was a proposal to have afunctioning National Employment Office, semi-public, like in Honk Kong.

Migrant domestic workers in Lebanon are legally invisible – UN expert on contemporary forms of slavery

BEIRUT (17 October 2011) – United Nations Special Rapporteur, Gulnara Shahinian, today urged the Government of Lebanon to enact legislation to protect some 200,000 domestic workers in the country, warning that without legal protection some of them end up living in domestic servitude, under absolute control and dependency on their employers through economic exploitation and physical, psychological and sexual abuses.

“Migrant domestic workers in Lebanon, majority of whom are women are legally invisible which makes them acutely vulnerable to domestic servitude,” said the UN expert monitoring contemporary forms of slavery, including its causes and consequences, at the end of her first visit the country. “The migrant domestic worker is required to live in their employer’s households, faces racial and gender discrimination and is deprived of the necessary legal protection to safeguard their rights.”

“I met with women who had been forced to work long hours without any remuneration or valid contract; physically and sexually abused; and morally harassed by constantly being insulted, humiliated and belittled,” Ms. Shahinian said stressing that the lack of legal protection leaves domestic workers vulnerable to domestic servitude at the hands of recruitment and placement agencies and ultimately at the hands of their employers.

The UN Special Rapporteur urged the Lebanese authorities to ensure that domestic workers obtain legal protection and have prompt and immediate access to remedies and justice, and that employers are aware of their obligations when recruiting domestic workers.

Ms. Shahinian noted that the Government has taken some positive measures such as the establishment of a hotline for receiving calls. A national steering committee was also formed to address the issue of migrant domestic workers. The committee succeeded in developing a standard unified contract and a new draft law for migrant domestic workers.

“This law has been in its drafting stage for the past three years and it is now time that it be made a priority by the government. The law needs to balance the rights and obligations of both the employer and employee. It also needs to explicitly guarantee that migrant domestic workers are allowed to keep their passports, have freedom of movement, a day off outside the employers’ house, adequate private lodging and fair wages” the UN expert said. “It also needs to establish criteria of what a potential employer must have and include specific provisions on how recruitment agencies are to conduct their work and be monitored.”

“Currently, the visa regime is such that if a domestic worker leaves an employer, she immediately breaks the law. In the case of a domestic worker held in domestic servitude, she is, as a result, treated as a criminal instead of a victim of human rights violations,” Ms. Shahinian said.

The human rights expert underscored that migrant domestic workers provide an indispensable contribution to society that allows many Lebanese women to leave their homes, gain economic independence and develop their careers. “If fair labour practices and human rights protections are ensured, the sector can offer domestic workers opportunities to earn an additional salary for themselves and their families and to have the opportunity to experience another country and culture.”

Domestic servitude: UN Expert on contemporary forms of slavery in first mission to Lebanon

GENEVA (7 October 2011) – United Nations Special Rapporteur Gulnara Shahinian will visit Lebanon from 10 to 17 October 2011, to assess a number of initiatives developed by the authorities to prevent domestic servitude. Ms. Shahinian is the first UN independent expert monitoring contemporary forms of slavery, including its causes and consequences, to visit the country.

“Slavery like practices remain a grave and persistent problem today,” said the Special Rapporteur, who is visiting the country at the invitation of the
Government. “This visit provides me with a unique opportunity to discuss and report on the impact of policies and programmes adopted by Lebanon to combat contemporaray forms of slavery.”

Ms. Shahinian’s mandate on contemporary forms of slavery includes issues such as debt bondage and forced labour.

During her eight-day visit, the human rights expert will travel to Beirut to hold discussions with government representatives, members of the judiciary, non-governmental organizations, community members, academics, labour recruitment agencies and others.

A press conference will be held in Beirut at the conclusion of the Special Rapporteur’s visit - on Monday, 17 October 2011 with additional information to follow. Ms. Shahinian will present the visit’s findings at the Human Rights Council in September 2012.

Regional Push for Rights of Women Migrant Workers

Lebanon Begins to Address Abuse of Domestic Workers

BEIRUT — Every year, promises of steady employment and wages higher than in their home countries draw hundreds of thousands of women from Africa and Asia to the Middle East for jobs as domestic workers. While they come to better their lives and those of the families they leave behind, many are met with a different reality: withheld paychecks, backbreaking hours, basic living conditions, confinement, and verbal, physical and sexual abuse.

In Lebanon, abuse has been so prevalent in recent years that Ethiopia, the Philippines, Madagascar and Nepal — all major sources of domestic workers for the country — have set bans on their citizens traveling here for employment.

While many of Lebanon’s estimated 200,000 domestic workers do encounter such abuses in the households where they are employed,
there are also moves by organizations to address the problems facing domestic workers.

On a recent Friday night, migrant workers from Africa and Asia joked with one another in English as they filed into a sparse, freshly painted room decorated only by a flat-screen TV playing a muted Bollywood film. They were arriving at one of the first meetings for Beirut’s new Migrant House, a Lebanese-funded, migrant-worker-run gathering spot in the city’s suburbs.

“We wanted a safe, migrant-friendly place where migrants can simply meet and use the space as their office and headquarters to organize themselves with the help of Lebanese activists,” said Ali Fakhry, a spokesman for the Anti-Racism Movement, the Lebanese group of social activists responsible for funding the Migrant House.

The ambition is to create an independent center where migrant workers can meet and organize in a country where foreigners are barred from unions and syndicates. The Migrant House will not only be open to migrant domestic workers — an almost exclusively female group — but also to migrant workers who are men, many of whom come to Lebanon to work as laborers.

To end abuses though, headway needs to be made in changing the mindsets of some in the Lebanese population toward domestic workers in a country where many refer to them as Sri Lankans no matter where they are from and negative stereotypes and prejudices still prevail.

“It is very hard to change their mentality,” said Priya Subedi, coordinator of the Migrant House, herself a former domestic worker from Nepal. “Even if they are educated — even lawyers and doctors — the girls in these houses are mistreated.”

Mr. Fakhry said, “The highest percentage of racism against the migrants is based on ignorance: They don’t know their culture, they don’t know their food, they don’t know their music.”

A number of organizations in Lebanon have introduced campaigns aimed at Lebanese employers to raise awareness against abuse and to break down cultural barriers and negative stereotypes.

Arabic-language children’s books created and distributed to youngsters by the International Labor Organization feature a young Lebanese girl who takes nocturnal educational trips in her dreams to the countries where domestic workers are from. Other booklets produced by the nongovernmental organization Caritas translate common words from Arabic into languages domestic workers speak and provide cultural information about their home countries.

For those domestic workers who are treated fairly — and allowed to leave their employer’s residences on days off — working in Beirut can offer some comforts of home. On weekends, domestic workers flock to Dawra, a neighborhood where restaurants sell cheap bowls of curry and stores carry everything from injera, the spongy Ethiopian flatbread, to the latest Tagalog-language films from Manila.

The Ethiopian pop star Teddy Afro plays sold-out gigs in Beirut, and his visage appears on many hats and T-shirts worn by domestic workers. Churches in the capital hold services in a number of languages spoken by domestic workers.

Days off are still a luxury rather than a standard for domestic workers here, however. Most domestic workers legally employed in Lebanon are brought into the country by recruitment agencies and live in Lebanon under a sponsorship system. To hire a domestic worker, employers pay agencies high fees to bring them to the country and cover their immigration papers in addition to paying the workers a monthly salary.

Critics of the way the domestic worker industry operates in Lebanon have said that the initial high fees that employers pay can sometimes result in the employers feeling that they can grant fewer rights to the domestic worker.

“There’s no freedom; you can’t speak to your employer,” said Aida Sabuero, 30, a domestic worker from the Philippines who has been working in Lebanon for nine years. For the first three years of her contract, she said, her employer did not grant her a single day off.

Withholding salaries, keeping the passports of employees and restricting their movements are all tactics that have been used by some employers to exert control over domestic workers and “protect” their overhead costs.

“Many employers of domestic workers say, ‘We pay a lot of money and we want to protect our investment,’ holding domestic workers hostage, by not allowing them outside,” said Simel Esim, a gender specialist working with the International Labor Organization in Beirut. “It may be true that they do pay a lot, but if one compares what percent of that money actually goes to the worker and how much goes to the agencies, then it is not hard to conclude that the sponsorship system, as is, is functioning as an unfair business that is largely unregulated and needs to be critically reviewed and substantially revised.”

A survey conducted this year by Caritas found that 70 percent of employers limit the freedom of movement of the migrant workers they employ. The survey also found that nearly 98 percent of employers retained possession of their employees’ passports.

Although the companies that bring in domestic workers are often criticized regarding the abuses that occur, Hicham al-Borji, president of the Syndicate of the Owners of Workers Recruitment Agencies, said the lack of government legislation on domestic migrant workers was a key problem. “Our laws in Lebanon don’t give us any power to follow any abuse cases,” Mr. Borji said.

Mr. Borji criticized companies that operate outside of his syndicate — which has signed a memorandum of understanding with Caritas to promote working standards — that do not respond to cases of abuse or hold employers to standardized contracts.

“The biggest problem is this group of agencies working in a very bad way and the impact of their work is very bad for us — and the countries of the workers,” Mr. Borji said, referring to the bans imposed by several countries on sending workers to Lebanon.

In Lebanon, the domestic worker industry is much more transparent than in some other regional countries, like Saudi Arabia, which has a far higher migrant domestic worker population. While multiple African and Asian countries have placed bans on their citizens working in a number of Middle Eastern countries, the number of domestic workers in the region continues to rise.

Despite this relative transparency and initiatives under way to address the problems facing domestic workers here, reform is still in its infancy and for many any change would come too late.

Marcy, 24, is a Kenyan domestic worker who was lured to Lebanon by a $200 per month salary. Instead of saving money as she had hoped, she said, her employer withheld her pay and overworked and verbally abused her.

Today she waits in a shelter for abused domestic workers as the legal tangles that resulted from her decision to run away clear so that she can return home. She said that the agency that recruited her in Kenya neglected to mention the problems that domestic workers can face in the Middle East.

“They said Lebanon is good,” she said. “But when I got here, I found that all they said were lies.”

تشترك وتختلف أوضاع عاملات المنازل الأجنبيات في كل من الأردن ولبنان ومصر. يشترك كل من لبنان والأردن بإجراءات تنظيمية وقانونية تبقي نظام الكفالة، الأقرب إلى العبودية الحديثة، أساسياً في العلاقة بين العامل/ة ورب العمل، وتفترق مصر لكون العمالة المنزلية فيها محلية بنسبة 90% وأبرز سماتها تشغيل الأطفال دون سن الـ18، فيما تشترك الدول الثلاث في غياب الحماية القانونية والاجتماعية للعاملين/ات في الخدمة المنزلية، وهي صفة عامة في قوانين العمل العربية، وأبرز أسبابها غياب ثقافة حقوق الانسان.
لعلها المرة التي يلتقي فيها أطراف فاعلون في الدول الثلاث في ورشة عمل عقدت الاسبوع الماضي قي عمّان ـــــ الأردن، أفضت الى الاتفاق على إنشاء شبكة تنسيق إقليمية تهدف إلى مكافحة
ظواهر العنف والاتجار والاستغلال التي تعانيها العاملات الأجنبيات في هذه البلدان الثلاثة وتعزيز حمايتهن قانونياً.
وينفذ المشروع المموّل من الاتحاد الاوروبي، من خلال اتفاقية شراكة بين مؤسسة عامل في بيروت، والاتحاد العام للمرأة الأردنية في عمان، ومؤسسة قضايا المرأة المصرية في القاهرة، وتتمحور نشاطاته حول كيفية توفير الحماية للعاملات الأجنبيات، وآلية معالجة الضحايا وعودتهن الى بلدانهن الأم، بالاضافة إلى تنظيم حملات لتجريم الانتهاكات بحقهن في البلدان الثلاثة المستهدفة.
يعيد د. نضال جردي، من المكتب الاقليمي للمفوضية السامية لحقوق الإنسان، سبب غياب الحماية القانونية للعاملات في الخدمة المنزلية في الدول العربية إلى ضعف المعرفة والوعي بحقوق هذه الفئة من العمال من قبل أرباب العمل ومكاتب الاستخدام والجهات الحكومية. ويلفت الجردي إلى أن ترك عملية تنظيم العلاقة التعاقدية إلى عقود ثنائية خاضعة لمظلة قانون الموجبات والعقود، أدى إلى انكشاف الطرف الضعيف في هذه المعادلة، أي العاملات، أمام شروط مجحفة وغير متوازنة لا تراعي معايير حقوق الإنسان إلا في ما ندر. كذلك اصطدمت أي عملية مراقبة وتفتيش بمدى تضارب حقوق العمال المنزليين مع مصالح أخرى يحميها المجتمع كالحق بالخصوصية وحرمة المنزل. ويطالب الجردي بضرورة ايجاد آلية رقابة عملية لتطبيق القانون، وهذا لا يكون إلا من خلال نظام تفتيش ومتابعة يزاوج بين ضمان المراقبة وامكانية وصول الشكاوى والتواصل مع العاملات في الخدمة المنزلية مع احترام الحق بالخصوصية للمنزل.
يطمح الجردي إلى تعميم تجربة لجنة التسيير الوطنية في لبنان حول تنظيم العمل في الخدمة المنزلية على باقي الدول في المنطقة العربية، ولقد شاركت المفوضية السامية لحقوق الانسان في اجتماعات هذه اللجنة التي ألّفها مجلس الوزراء وأنيطت بها مهمة الإعداد لمشروع قانون تنظيم العمالة المنزلية ووضع كتيّب إرشادي، بالإضافة إلى عقد عمل موحد.
رئيس مؤسسة عامل الدولية د. كامل مهنا الذي قدّم ورقة عمل خلال المؤتمر حول الواقع اللبناني رأى أن الإصلاحات الأخيرة، بما في ذلك إقرار عقد العمل الموحد لعمال/ات المنازل الأجانب في لبنان، لم تذهب بعيداً بما فيه الكفاية لحمايتهم من سوء المعاملة والاستغلال. وذلك بسبب غياب آلية لتنفيذه ومحاسبة أصحاب العمل الذين يخرقون شروطه. ولفت مهنا الى أن الأنظمة الحالية تدعم سلطة صاحب العمل على مستخدميه وتثني العاملات اللواتي يتعرضن للانتهاكات عن التماس أي إنصاف أو تعويض. كما أن عدم الرغبة في التدخل في خصوصية المنزل يمنع السلطات من الرصد الفعال لأوضاع عاملات المنازل الأجنبيات أو التحقيق في ادعاءات سوء المعاملة، على غرار طريقة التعامل مع وضع المرأة اللبنانية التي لا يجري التحقيق في حدوث إساءة بحقها ما لم تتقدم الضحية نفسها بالشكوى. وفي كلتا الحالتين، يساهم التمييز القائم على أساس الجنس في نشر العنف وسوء المعاملة وفي التزام الصمت حيال ما يحدث داخل حرمة المنزل.
بدورها، ركزت المنسقة الاقليمية لمشروع «تحسين أوضاع العاملات الأجنبيات في الوطن العربي» ناديا شمروخ على المشكلات المشابهة التي تعاني منها العاملات الأجنبيات في الخدمة المنزلية في الأردن مع فارق أن نسبة العاملات الأجنبيات في لبنان أعلى ثلاثة أضعاف عنها في الاردن رغم الفارق الكبير في عدد السكان (لبنان 4.5 ملايين نسمة والأردن 6 ملايين نسمة). وعرضت شمروخ جهود اتحاد المرأة الأردني في هذا المجال، ومن بينها مركز الحماية الخاصة بالعاملات الأجنبيات المعنفات وتقديم الاستشارات القانونية لبعض الحالات الخاصة، اضافة الى برامج خدمات نفسية وطبية واجتماعية.
وفي ورقة بعنوان «داخل البيوت خارج القانون»، قدم المستشار في محكمة النقض المصرية عمرو الشيمى مجموعة مقترحات لتحسين أوضاع فئة عمال الخدمة المنزلية ومن في حكمهم، المستثناة من الحماية القانونية التي يكفلها قانون العمل المصري لسنة 2003. ومن بين هذه المقترحات مساواة عمال المنازل مع غيرهم من العمال في الحقوق والواجبات من خلال النص التشريعي الصريح على عدم استثناء هذه الفئة من أحكام قانون العمل، وتفعيل النص الوارد في قانون النقابات، لجهة حق العمال المنزليين في تنظيم أنفسهم في نقابة تمثلهم وترعى حقوقهم، وتطبيق حد أدنى لأجور العمال المنزليين أو على الأقل توفير مستوى أجور ملائم في إطار قانوني، بما يخرجه من دائرة التجريم بالإتجار بالبشر، وحظر عمل الأطفال في الخدمة المنزلية تماماً، ووضع نموذج عقد بين العامل ورب العمل وفق أحكام القانون المدني لضمان آليات الحماية والتأمين الاجتماعي.
محمد مطر مدير برنامج الحماية من الاتجار بالبشر في جامعة جونز هوكنز في الولايات المتحدة الأميركية، نوه بصدور القانون اللبناني رقم 164 حول معاقبة جريمة الاتجار بالاشخاص الذي نشر في الجريدة الرسمية مطلع شهر أيلول الماضي. ولقد أدخل بموجب هذا القانون فصل جديد إلى الباب الثامن من الكتاب الثاني من قانون العقوبات بعنوان «الاتجار بالأشخاص». ولفت مطر الى أن التقرير السنوي الأميركي حول الاتجار بالاشخاص قد ساهم في التعجيل في صدور العديد من التشريعات الوطنية. قائلا إن هناك 65% من دول العالم أصدرت في السنوات الخمس الماضية تشريعات خاصة بتحريم التجارة بالبشر. ولفت مطر إلى أن العاملات في الخدمة المنزلية يتعرضن إلى الإساءة الجنسية والاسترقاق أو الممارسات الشبيهة بالرق والعمل القسري أو الإلزامي، وهي جميعها ممارسات تدخل في نطاق جرائم الاتجار بالبشر. وأكد مطر حصول خروقات واضحة لبروتوكول الأمم المتحدة لمنع التجارة بالبشر وقمعها ومكافحتها، وقد وقعت عليه 9 دول عربية بينها مصر ولبنان والأردن. وطالب مطر بأن تتضمن التشريعات العربية نصاً يضمن استخدام مصادرة عائدات الجرائم المتأتية من جريمة التجارة بالأشخاص لتعويض ضحايا هذه الجرائم كما تنص المادة 14 من البروتوكول الأممي.

إلغاء نظام الكفالة
«سوف تقدم وزارة العمل خلال ممارستها اليومية وضمن فترة قصيرة على اجتثاث منطق الكفالة». هذا الكلام أدلى به قبل أسبوع وزير العمل شربل نحاس، وتفسيره العملي رمي مسودة مشروع قانون «تنظيم العمل اللائق للعاملين في الخدمة المنزلية» في سلة المهملات.
وكان مشروع القانون الذي أعده الوزير السابق بطرس حرب قد لاقى اعتراضاً واسعاً من الجمعيات المدنية اللبنانية لكونه يستثني العاملين/ات في الخدمة المنزلية من الحقوق والميزات التي يكفلها قانون العمل اللبناني، مثل الحد الأدنى للأجور والحدّ الأقصى لساعات العمل، الحق في تأمين صحّي جدّي وشامل، والحق في تأليف نقابة تمثّل هذه الفئة وتدافع عن قضاياهم/هنّ. كذلك يرسّخ مشروع القانون نظام الكفالة الذي يجهّز الأرضية لعدد كبير من الانتهاكات. ويأتي توقيع لبنان على اتفاقية منظمة العمل الدولية بعنوان «العمل اللائق للعمال المنزليين» في جنيف في نيسان الماضي سبباً اضافياً لسحب مشروع القانون من التداول والمباشرة بإعداد مسودة جديدة قبل رفعها الى مجلس الوزراء.

New York (TADIAS) – Widespread news coverage of an Ethiopian migrant worker in Libya, Shweyga Mullah, who had cared for two of Moammar Gadhafi’s grandchildren and suffered abuse and severe burns, has elicited heated reactions from Ethiopians worldwide. Her story brings to the forefront the plight of thousands of female Ethiopian migrant workers who continue to work under dangerous conditions in various countries in the Middle East.
“My heart is burning,” said Rahel Zegeye, who left Ethiopia when she was 20 years old to work as a maid in Lebanon. She still works and resides there. “The Ethiopian government should press charges against the madam (Aline Skaf-Hannibal). I would like to see equal treatment of the case no matter who committed the crime.”
Rahel is also the Director of a new film called Beirut, which documents Ethiopian domestic workers in Lebanon.
We recently interviewed Rahel Zegeye about her movie and the living conditions of Ethiopian women in the Arab world.

TADIAS: Thank you Rahel for your time. Please tell us a bit about yourself. Where you were born, grew up, and when did you move to Lebanon and why?

BEIRUT: Migrant workers will now receive information packs on their rights and responsibilities upon arrival in Beirut, and airport staff will undergo training on how to recognize vulnerable people, General Security announced Thursday.

Staff at Beirut Rafik Hariri International Airport will attend workshops, held by the nongovernmental organization Caritas, on migrant rights, how best to deal with migrant workers when they arrive in Lebanon and how to get them the relevant help if they appear to need it.

Dima Haddad, project manager at Caritas Migrants Center, said staff will be instructed on how to notice certain behavior. “Airport staff will receive training on how to detect vulnerable people, anyone who might have been trafficked, for example,” Haddad said.

The designated areas for migrant workers, upon arrival at the airport, have also been redecorated, in an effort to create a more welcoming atmosphere.

“The rooms at the airport, assigned for migrant workers, have been completely renovated as well. They are human spaces now,” she added.

Newly arrived migrant workers will also receive information packs – which are also aimed at their Lebanese employers – to help them settle into life in Lebanon.

The packs – available in nine languages – outline a migrant worker’s rights, including the right to one day off every week, and the right to rest; the right to a “clear employment contract in an understandable language”; the right to protection from arbitrary arrest and detention; the right to protection from all forms of exploitation, violence and sexual harassment; and the right to equality before the Lebanese law.

Introductory language guides are also included, which feature sections on practical terminology such as food preparation and household tasks but also personal and legal phrases, such as “I will speak to the agency,” “Where is my salary?” and “Don’t hit me.”

The packs also provide information about Lebanon for the migrant workers and basic facts about the culture and customs of the worker’s home country for their employers.

The booklet on Madagascar, for example, outlines topics such the country’s history, religious composition, styles of dress, marriage traditions and food. “Spicy curries are popular, as are numerous exquisite French dishes,” it reads.

“The information packs we provide will facilitate the reintegration into society of migrant workers,” Haddad said.

The packs also contain information on the best people to contact, should migrant workers face any problems while in Lebanon, to help prevent them “falling into gangs,” she added.

Brig. Maarouf Itani, representing Maj. Gen. Abbas Ibrahim, head of General Security, spoke at the launch, and said the steps revealed the government’s ongoing cooperation with Caritas to “offer the necessary guidelines to foreign workers and the implementation of the human rights charter and relevant laws, especially after the passage of the human trafficking law.”

Parliament recently passed the first comprehensive law to criminalize human trafficking in Lebanon. Human rights groups have expressed concern that many migrant workers are brought into the country against their will, or under false pretenses, and are often prohibited from leaving the country once they arrive.

Itani also said that the introduction of the training program, and the information packs, revealed a will to “improve a level of services and offering a better picture of Lebanon and its institutions by affirming the respect of the rights of foreign nationals, whatever their nationality or race.”

In exchange for this, he said, foreign nationals must also increase “respect for Lebanese laws and regulations.”

There are thought to be several hundred thousand foreign migrant workers in Lebanon, including around 200,000 domestic workers.

Calls are growing, from civil society organizations and human rights groups, for the Lebanese government to do more to protect migrant workers from exploitation and abuse.

The Philippines, Ethiopia, Nepal and Madagascar currently all have a ban on their citizens traveling to Lebanon for work, citing such living conditions.

The first training session, for 20 airport staff will begin Sept. 13.

KAFA launches domestic workers rights campaign

The nongovernmental organization KAFA: Enough Violence and Exploitation has launched a media campaign to raise awareness of the often dangerous conditions which foreign domestic workers endure in Lebanon and to urge authorities to implement the relevant legislation needed to protect them.

The stark poster features the image of a hanging noose, and reads: “Don’t push her to commit your crime: toward legal protection for domestic workers in Lebanon.”

In a statement, KAFA laid out some of the rights which domestic workers are often deprived of in Lebanon, including the right to rest, travel and communicate and the right to keep their own private documents, such as passports.

The statement adds that many workers are subjected to violence, sexual abuse and even human trafficking.

At first I thought she was wearing a hat and something over her face. Then the awful realization dawned that her entire scalp and face were covered in red wounds and scabs, a mosaic of injuries that rendered her face into a grotesque patchwork.

Even though the burns were inflicted three months ago, she was clearly still in considerable pain. But she told us her story calmly.

She'd been the nanny to Hannibal's little son and daughter.

The 30-year-old came to Libya from her native Ethiopia a year ago. At first things seemed OK, but then six months into her employment she said she was burned by Aline [Skaff*].

Three months later the same thing happened again, this time much more seriously.

In soft tones, she explained how Aline lost her temper when her daughter wouldn't stop crying and Mullah refused to beat the child.

"She took me to a bathroom. She tied my hands behind my back, and tied my feet. She taped my mouth, and she started pouring the boiling water on my head like this," she said, imitating the vessel of scalding hot water being poured over her head.

«بيت المهاجرين»: مساحة خاصة بأبناء الجاليات المنتهكة حقوقها في لبنان

حياة العاملين المهاجرين إلى لبنان صعبة، ومليئة بالانتهاكات. فالمعاناة تبدأ من رميهم بكافة أشكال العنصرية اللبنانية، ولا تنتهي عند الضرب والتعنيف والتعذيب والحرمان من أبسط الحقوق الإنسانية، كالترفيه عن النفس. فيواجه أبناء الجاليات النيبالية، والبنغلادشية، والهندوسية، والسريلانكية، والأثيوبية، والفيليبينية، وغيرها من أصحاب الجنسيات المهدورة الحقوق في لبنان، مشكلة في إيجاد مكان يجمعهم ويحضن بعضاً من نشاطاتهم.
ولكن، يبدو أن تلك الحال تمضي إلى تغيير، مع افتتاح مركز خاص يحضنهم في منطقة النبعة، يحمل اسم «بيت المهاجرين ـ Migrant house، يقع إلى جانب المدرسة الأرمينية الإنجيلية.
وفي الحادي عشر من أيلول المقبل، يُفتتح المركز بتمويل من «حركة مناهضة العنصرية»، وبمساهمات فردية وبمعاونة بعض الممولين الدوليين، وهو «يُعدّ ليستقبل المهاجرين/ات وعاملين/ات أجانب/يات في الخدمة المنزلية

من جميع الجنسيات والإثنيات»، كما يشير الناشط علي فخري من «حركة مناهضة العنصرية». ويلفت فخري إلى أن «المختلف في هذا المشروع - البيت هو أن ادارته ونشاطاته ستعد من قبل أبناء الجاليات أنفسهم وسيكونون هم (مداورة) في سدة القرار وهم في موقع المسؤولية».
بعد أشهر من البحث عن موقع، ومن ثم التصليح والدهان والتأهيل، ولد بيت المهاجرين المؤلف من ثلاث غرف، نوافذه حمراء تشرف على شارع ضيق يقع في وسط النبعة. ولانجاز التجهيزات الأخيرة، تعمل حالياً ويومياً في البيت، منسّقته الناشطة الحقوقية النيبالية بريا سوبيدي، وتتعاون وزوجها، وهو رئيس الجالية النيبالية في لبنان ديباندرا أوبرتي (وكلاهما يعمل في القنصلية النيبالية)، على تنسيق نشاطات المركز، وجداول استقبال أبناء الجاليات، وذلك طبعاً بدعم دائم من الناشطين علي فخري وفرح سلكا.
بريا، الشابة ابنة الأربعة والعشرين عاماً، وصلت إلى لبنان في العام 2004، وعملت فيه كخادمة في أحد المنازل. وتعرفت الى ديباندرا الذي يعمل في لبنان منذ 13 سنة، ثم تزوجا في بلادهما، وعادا ليعملا هنا. يبدو الزوجان فرحين، بل فخورين جداً بالبيت الصغير الذي تعتبره بريا «متنفساً لأبناء جاليات تعاني الأمرين في لبنان، وتجابه بتصرفات عنصرية كل الوقت، منذ الثانية التي يدخلون فيها إلى المنازل للخدمة، إلى الشارع، عند ركوب سيارة الأجرة، وعند شراء الحاجيات «للمدام» أو لأنفسهم..».
تقول بريا عن بيت المهاجرين أنه «سيكون الحضن الذي يجمع أبناء الجاليات ليتواصلوا ويتشاركوا تجاربهم اليومية، همومهم، وفي الوقت نفسه سيكون المكان الذي يلم شملهم في حفلات غنائية، ومسرحيات وأنشطة ترفيهية، وطبعا يمكنهم استخدامه بشكل مجاني، بدلاً من استئجار أماكن مكلفة أو أحياناً اللجوء إلى الملاعب أو الكنائس».

المنزل المطلي حديثاً بالأبيض والأزرق والأحمر، لن يكون مجرد مساحة للتجمع والدردشة وقضاء الوقت فقط، بل تجزم بريا بأنه «سيقدم دورات لغة مجانية لأبناء الجاليات تساعدهم على التواصل والاندماج في مجتمعهم اللبناني الحالي وفي عملهم، ويقدم الدورات لمتطوعين يستطعون الترجمة من اللغة الأم لكل جنسية إلى العربية أو الانكليزية، بالاضافة إلى تجهيز المنزل بأجهزة كومبيوتر وتوفير خدمة الانترنت بحيث يمكن لهم أن يتواصلوا مع أصدقاء لهم».
بدوره، يجزم علي فخري أن «عمل المنزل ونشاطاته ستكون مرتبطة بعمل حركة مناهضة العنصرية، وبالتالي، يمكن لأبناء الجاليات أن يحصلوا على خدمات قانونية.. بمعنى أن يستمع محامون متطوعون إلى مشاكلهم وشكاواهم على مستويات التحرش الجنسي، والتقصير في دفع الرواتب، وساعات العمل، والأفعال العنصرية تجاههم، وتعنيفهم، ويحاولوا أن يصححوا أوضاعهم، وذلك يحتاج طبعاً إلى تطوع عدد من المحامين».
بناء على ذلك، ترى الناشطة فرح سلكا أن «وجود منزل ومكان آمن للمهاجرين/ات والعاملين/ات أجانب/يات في الخدمة المنزلية ضروري جداً ليشعروا/ن بالطمأنينة ويكونوا/ن منتجين/ات اجتماعياً وثقافياً، بعيداً عن الجو العدائي والعنصري الذين/اللواتي يتعرضون/يتعرضن له في معظم الأماكن العامة في لبنان».

-- From late 2005 to early 2006, Lebanon (refused to grant visas) to Ethiopian nationals. However, thousands of Ethiopians illegally crossed the border in pursuit of work (and/or as victims of trafficking). Over the last 14 months (since Lebanon has lifted their visa ban against Ethiopian nationals), the amount of trafficking to Lebanon has increased.

-- IOM officials cite Yemen as a significant transit point, for young Ethiopian girls (average age 14-15) being trafficked to Djibouti. A recent impact assessment concludes that many of these trafficked girls in Djibouti have HIV/AIDS.

-- There are no reports of trafficking of Ethiopians to the United States. A few years ago, IOM reported that approximately a dozen clients claimed that a smuggler was charging up to 80,000-100,000 birr (USD 9,050- 11,312) to smuggle them into the United States. Since then, there is little to no information available about these routes. Yemen and Lebanon have been identified as some of the most popular destinations for trafficking and smuggling.

مكتب لتعليم الخدمة... والعقليّة اللبنانية

إنه مكتب لتعليم الخدمة وليس استقدام عاملات. فهل تحتاج الخدمة إلى تعليم؟ تأتي الإجابة بـ«نعم»، في ظل معاناة تستمر أشهر بين العاملة وسيدة المنزل. قد لا يغيّر التعليم من منطق «الخدمة»، فهل يغيّر في منطق الحقوق؟

في أوائل الشهر الماضي، افتتحت مؤسسة «راي غروب» المركز الأول في لبنان والشرق الأوسط للتدريب على التدبير المنزلي والتنظيف على أنواعه (خصوصاً للعمّال الأجانب)، إضافة إلى أسلوب جديد لإعداد المائدة اللبنانية، بحسب مؤسّسها رشيد بيضون. لكن هل يحتاج التدبير المنزلي والتنظيف إلى مكتب متخصّص؟ يجيب بيضون بـ«نعم»، مسلّطاً الضوء على معاناة اللبنانيين في تأهيل العاملات من الصفر. تشرح إحدى السيدات التي لجأت إلى المكتب لتدريب الفتاة الإثيوبية التي تعمل لديها، قائلة إنها «لم تكن تعرف شيئاً على الإطلاق. ولأنها امرأة عاملة، وجدت في المؤسسة فرصة قد تكون مفيدة». لاحظت السيدة الفرق. 5 أيام كانت كفيلة بإحاطة الفتاة بما يحتاج إليه المنزل. مدة التدريب هي 4 أيام في مقابل 170 دولاراً. وإذا أرادت سيدة المنزل تعليم الفتاة إعداد الطعام الأوّلي وترتيب المائدة، تُضاف 3 أيام في مقابل 100 دولار. تجارة هي إذاً. يرفض بيضون هذا الوصف قائلاً: «لو أردت أن أكون تاجراً لفتحت مكتباً لاستقدام العاملات».

بعض العاملات الأجنبيات يخضعن للتدريب في بلدانهن قبل

المجيء إلى لبنان، كما في بنغلادش. لكن فرح التي استقدمت بنغلاديشية، اضطرت إلى إعادة تدريبها، «فطريقتهم مختلفة». لكنها تسخر من فكرة المكتب، «راتب العاملة الشهري لا يتجاوز 125 دولاراً، فكيف أدفع 170 دولاراً مقابل 4 أيام؟».

مركز المؤسسة هو عبارة عن بيت مؤلّف من غرف عدة. المدخل مخصّص لترتيب مائدة الطعام وفن الضيافة اللبنانية. هناك غرفة مخصصة لتعليم تنظيف البلاط والرخام و«الباركيه». أخرى لتعليم غسل الملابس وكيّها، تنظيف الزجاج والخشب، تنظيف المرحاض يومياً وأسبوعياً، إضافة إلى ترتيب الأسرّة. تضاف إلى ذلك محاولة معالجة المشكلة الأساسية، برأي بيضون، التي تكمن في عدم القدرة على التواصل بين العاملة الأجنبية وسيدة المنزل. لذلك، وعدت «كاريتاس» المؤسسىة بتزويدها بكتيّب لتعليم المفردات الأساسية التي تحتاج إليها العاملة للتواصل. لكن منسّقة المشاريع في المنظمة، حسْن صياح، أوضحت أن الفكرة أوّلية، لأنها بانتظار رؤية النتائج على الأرض. حتى إنها رفضت إبداء رأيها في فكرة المكتب، قائلة: «قد تكون فكرة ممتازة والتنفيذ سيّئ، والعكس صحيح».

يحرص بيضون على الجلوس مع سيّدة المنزل لمعرفة جميع طلباتها وخصوصياتها قبل تدريب العاملة. مثلاً كيف تحبّ قهوتها؟ يحكي كثيراً عن خصوصيات العائلة اللبنانية، منها عدم تقبّل منح العاملة عطلة يوم الأحد. ويلفت إلى توعية العاملة على حقوقها وعدم نقل أسرار البيت إلى الخارج، وخصوصاً أن «بعض الشباب قد يستدرجنها لسرقة المنزل».

تالا فتاة إثيوبية تعمل في لبنان منذ أربع سنوات، وهي مسؤولة عن تدريب العاملات الجدد في المؤسسة. تبدو قليلة الكلام، أو ربما عاجزة عن توضيح فكرتها بالعربية، لكنها تحلم مستقبلاً بفتح مكتب مماثل في إثيوبيا. اعتادت أن تساعد والدتها في الأعمال المنزلية، لذلك لم يكن الأمر صعباً أو مختلفاً في بيروت. تبقى الإحاطة بالعقلية اللبنانية. لكن ما قصة هذه العقلية؟ لاحظت زميلة تالا، سوزان، أن اللبنانيين شديدو الحرص، وأحياناً قساة، بحسب تجربتها. ربما هو نتاج العنصرية المتبادلة بين البشرتين السوداء والبيضاء. يحكي بيضون الذي عاش سنوات في أفريقيا، كيف أن الأفارقة لا يحبون اللبنانيين. ومن هنا تبدأ صعوبة التواصل. وجدت تالا في «الخدمة» استمراريتها. حلم العودة إلى الوطن منوط بتصدير مزيد من الإثيوبيات للخدمة في المنازل، وليس البحث عن طريق جديد.

المهتمون بالمكتب ما زالوا قلّة، يقتصرون على بعض الأصدقاء. يشير بيضون إلى اتفاقه وإحدى الجمعيات على تدريب نحو 100 عراقي. طرحت المؤسسة نفسها مصلحة اجتماعية. لكن هل سيراقب هذه العاملة في البيت التي تعمل لديه؟ هل باستطاعته محاسبة سيدة المنزل إذا لم تحترم حقوق العاملة؟ الأسئلة كثيرة، وقد لا تأتي الأجوبة. وإن أتت، فهي لن تغيّر منطق الخدمة.

"Being mostly illiterate and unaware, they are easily duped. For instance, though they get free visas, many agencies swindle them."

"The more dangerous ruse is making them go though India. If their documents are not in order or they are being lured to banned destinations like Lebanon, immigration authorities at Kathmandu airport will spot the fraud. So they are made to go to India first. It increases the danger of the women being forced into the flesh trade."

BBC: 'Slave maid' in Lebanon

Forced to work as a "slave maid" for wealthy families in Lebanon for 15 years, Abeline Baholiarisoa - a 59-year-old woman from Madagascar - finally achieved her freedom in March.

Madagascar's government chartered a plane to evacuate her and 85 other women.

The youngest of her four children, whom she left behind when he was six years old, played a key role in her evacuation, tracking her down via a welfare agency that rescues "slave maids", she says.

Ms Baholiarisoa says she was trapped in "a living hell" after being duped into going to Lebanon.

A recruiting agency had promised her a nursing job for three years, with a salary of $800 (£486) a month.

Ms Baholiarisoa says she thought it would give her a chance to save money, which she could send to her children.

But her dream was shattered the minute she touched down in Beirut.

"It was a trap, because as soon as I got there they took away my papers and said my contract didn't mean anything," Ms Baholiarisoa says.

"They said, 'Abeline, this is null and void.' For the next 15 years they shattered my life and the lives of my children."

Ms Baholiarisoa says she was put to work as a maid with another Malagasy woman in the house of a rich couple with newborn triplets.

"We didn't have time to eat or sleep - night and day. We didn't even have time to clean ourselves.

"I worked 24 hours a day and received $160 a month. From this, I had to pay the lady of the house money for my food because they only gave us a quarter of a loaf of bread and some bits of fruit each day."

'Women crippled'

Ms Baholiarisoa says she ran away from her first job after seven months and her second job after two years.

But with no papers and no way to return home she was forced to accept maid jobs for 12 more years.

Fabienne Marie Ange - a social worker with Madagascar's Union of Qualified Domestic Workers (SPDTS), which specialises in helping "slave maids" - says many of them are so traumatised that they do not even know where they are.

"Sometimes in Lebanon the boss gives them drugs to keep them strong. They have to work 24 hours a day, seven days a week and they don't eat properly. It has an effect on their mental [health]," Ms Ange says.

Ms Baholiarisoa says she refused her employer's attempts to give her pills for "stress", but she knew of people who ended up with an "empty brain" after taking them.

"You become like a beast, like an animal made for work," she says.

Some women are forced to work in Lebanon's clubs and streets as prostitutes, while some maids sell their bodies on the side just to pay for food, Ms Ange says.

According to SPDTS President Noro Randimbiarison, some of the women have died in mysterious circumstances in Lebanon.

When their bodies were eventually returned to Madagascar, it was discovered that several of them had missing organs.

"Some families decided to open the coffin and found that the girl didn't have eyes, her eyes had been replaced by doll's eyes, or they didn't have a tongue or intestines or the heart. This really happens. It's real," says Ms Randimbiarison.

Medical reports on the cause of death are vague - and some families have been told that the women committed suicide by jumping off tall buildings, she says.

Ms Baholiarisoa claims women were pushed from windows, sometimes to cripple them just enough so they could not run away; others disappear, fuelling suspicion that they were killed.
'Trafficking rackets'

"We have no idea how many women have died out there or have gone mad because if you ask a boss where is his maid they say she ran off with someone and it's over," she says.

"Where is the proof that she's run off and they haven't buried her in the courtyard? We don't have any proof."

Madagascar's Minister of Population Nadine Ramaroson, the only government minister tackling the issue, says "a very organised network" involving senior government officials and businessmen emerged in the 1990s to engage in human trafficking.

Government officials provide fraudulent work permits, travel and identity document for around $5,000 per trafficked woman, social workers say.

Ms Ramaroson says the government is trying to break the criminal networks, but it is not easy.

While one job agency flew 300 women to Jordan last month with the government's approval, 43 women bound for Saudi Arabia and Kuwait were stopped from boarding planes.

Ms Ramaroson said all were recruited from remote rural areas with high illiteracy and poverty levels. Some 16-year-old girls were given forged identity papers showing their age as 21.

She said their contracts stated they would work in top institutions "when these girls don't even know what electricity is".

Ms Baholiarisoa considers herself lucky. Given up for dead by her older children, her youngest child - now an adult - contacted SPDTS to help trace his mother.

They picked up one of her many calls for repatriation at the consulate in Beirut, she says.

Ms Baholiarisoa now helps SPDTS track down other women trying to escape Lebanon and to prevent other women from being duped into taking jobs in the Middle East.

"If the madam at SPDTS hadn't taken me in with open arms I don't know what I would have done," she says.

"It pains me that these girls are leaving because I know what awaits them, especially the beautiful ones."

From the plane load of women rescued in March, Ms Baholiarisoa is the only one with a job.

Some of the women have returned to discover husbands remarried and children adopted.

Others, like Ms Baholiarisoa, have to rebuild relationships after much hurt and loss.

لم يكن قد مضى أكثر من ستة أشهر على مباشرة «كلارا» العمل في منزل مخدومها في غزير، في قضاء كسروان، عندما قررت الهروب بـ»أي ثمن». انتظرت الصبية الفيليبينية خلود سكان المنزل الى النوم، ورمت بنفسها من الطابق الثاني. وعلى الرغم من التواء ساقها، أكملت «كلارا» فرارها، مستقلة سيارة أجرة إلى بيروت.
تقول «كلارا» لـ»السفير» إن عملها «كان يبدأ عند السادسة صباحاً، ويمتد حتى منتصف الليل». ولم تحصل خلال ستة أشهر أمضتها في العمل على راتبها كاملاً سوى مرة واحدة، ولكنها «حظيت» بالكثير من «الصفع والركل من صاحب المنزل وزوجته بسبب مطالبتها بأجرها». طبعاً، كانت «كلارا» تنام في المطبخ، مفتقدةً أي خصوصية حياتية.
يسلّم مسؤولون رسميون وحقوقيون وناشطون في مجال حماية الفئات المهمشة، ومن ضمنها العاملات في المنازل، بأن انتهاك حقوقهم يشكل ظاهرة مقلقة في لبنان، لناحية تعرّضهم لـ»باقة» كبيرة من الإساءات الجنسية والاقتصادية والنفسية والجسدية.
وفي ظل استثنائهن من قانون العمل اللبناني،

تُترك العاملات في المنازل فريسةً للاستضعاف والانعزال والارتهان المطلق لإرادة الكفيل، الذي يحدد شروط العمل وآلياته، بينما يضع الناشطون في مجال حقوق الإنسان جملة من الملاحظات على مشروع قانون العمل الخاص بهن، الذي وضعه وزير العمل السابق بطرس حرب، ويشيرون إلى نواقص كثيرة تعتريه.
وتقسّم الناشطة في جمعية «كفى» مايا عمّار، الإساءات التي تتعرض لها العاملات المنزليات الى «اقتصادية» تتمثل بعدم دفع رواتبهن، سواء في الوقت المحدد أو بالكامل، و»نفسية» تتجلى في منع عاملة المنزل من الاتصال بعائلتها أو تقييد حركتها في أوقات فراغها، و»لفظية» يُعبّر عنها باستخدام الألفاظ المهينة والمذلة بحق العاملة أو السخرية من لفظها أو ملبسها أو ديانتها، و»جسدية» تُمارس عليها بالضرب والركل والحرق وغيرها من الممارسات التعنيفية.. و»جنسية» تبدأ من التحرش وتصل إلى حدّ الاغتصاب.
القانون.. وفوقية المخدوم المَرضية
يقول وزير العمل السابق بطرس حرب لـ»السفير» إن معرفته بالواقع السيئ للعاملات هي ما دفع به إلى اقتراح «مشروع قانون تنظيم العمل اللائق للعاملين في الخدمة المنزلية»، مستنداً إلى تقارير منظمات حقوقية وإنسانية لبنانية وعالمية تتناول معاملة «يندى لها الجبين» بحق العمال الأجانب في لبنان، ولا سيما في المنازل. ويلحظ القانون الجديد، وفق حرب، إنشاء جهاز شرطة اجتماعية في وزارة العمل مؤلف من مرشدات اجتماعيات لهن الحق بدخول المنازل، والتحقيق في الشكاوى المقدمة، وإيداع النيابة العامة النتيجة. وفي ما يبدو صدى للملاحظات المحلية والدولية على القانون، يرى حرب أنه «ربما لا يكون منصفاً في كل جوانبه، أو ملبياً لطموحات المجتمع المدني والهيئات الحقوقية والإنسانية، ولا يعالج الشوائب كلها». ولكنه، بالنسبة إليه، «يشكل قفزة نوعية إلى الأمام حيث إنه، للمرة الأولى في لبنان، يتم اقتراح قانون لتنظيم العلاقة بين العاملين في الخدمة المنزلية وأرباب العمل». ويشير حرب إلى الانطباعات الايجابية التي تركها المشروع «لدى المنظمات الحقوقية والإنسانية الدولية، ومن بينها منظمة العمل الدولية»، فيردّ جزءاً كبيراً من المشكلة إلى «النظرة الاستعلائية عند قسم من اللبنانيين تجاه العامل الأجنبي».
ويبرهن ذلك فعلٌ أقدم عليه أستاذ جامعي أحرف اسمه الأولى هي: غ. ز.. فيعترف أستاذ القانون لـ»السفير» بأنه لفق تهمة السرقة للعاملة في بيته، «بعد هربها منه». يقول غ. ز. انه تنازل عن شكواه بعدما ألقت القوى الأمنية القبض على السيدة السريلانكية التي كانت تعمل في بيته، وبعد سجنها في مخفر حبيش لأيام عدة تعرضت خلالها للإهانة والضرب. يعلل «الأستاذ» فعلته بالرغبة بـ»الانتقام» من العاملة بسبب هروبها من منزله.
وكمثل آخر على «فوقية» اللبنانيين المَرضية، تخبر «برناديت»، وهي عاملة سريلانكية، «السفير»، بأنها تضطر في أحيان كثيرة إلى الوقوف في الحافلة، على الرغم من وجود أماكن شاغرة فيها، لأن الركاب لا يسمحون لها بالجلوس إلى جانبهم.
يعتبر الدكتور زياد صائغ، وهو من المشاركين في صياغة مشروع القانون الجديد، أن مشروع القانون «أتى ليحرّر العمال المنزليين من الاستغلال، عبر تحديد ساعات العمل، ومنحهم يوماً كاملاً للراحة الأسبوعية. كما حفظ لهم الحق بالتعويض في حال فسخ العقد من قبل رب العمل، بما يعادل نصف أجر شهري عن كل عام عمل لغاية خمس سنوات، على أن ترتفع النسبة إلى 65 في المئة، عندما تتجاوز سنوات العمل تلك المدة. وبالنسبة إلى الصايغ، «يلحظ مشروع القانون آلية جديدة لتنظيم مكاتب الاستخدام عبر إلزامها بالحصول على ترخيص من وزارة العمل لممارسة عملها.
ملاحظات الناشطين على قانون حرب
لا ينفي نضال الجردي، مسؤول حقوق الإنسان في مكتب منظمة الأمم المتحدة في بيروت، بعض ايجابيات مشروع القانون الجديد، ومنها «إيجاد آلية محدثة للتأكد من صون حقوق العاملين في الخدمة المنزلية عبر جهاز الشرطة الاجتماعية التابع لوزارة العمل، وتحديد ساعات العمل والعطلة الأسبوعية، ولكنه «يزخر» بعدد من الفجوات. وعلى سبيل المثال لا الحصر، يحجب مشروع القانون عن العاملين في الخدمة المنزلية حق التنقّل بحريّة في أيام راحتهم الأسبوعية، ويربطها بموافقة رب العمل، «وهذا مخالف لمبدأ شرعة حقوق الإنسان». كما أنه، وفق الجردي، «لم يتحدث صراحة عن حق العاملة المنزلية في غرفة خاصة بها، واكتفى بتحديد: «مأوى لها للنوم والراحة داخل المنزل الذي تعمل فيه»، مما يُعدّ مخالفة لاتفاقات العمل الدولية التي وقع عليها لبنان». إذ يمكن للمأوى أن يكون مكاناً لا تتوفر فيه شروط الكرامة الانسانية، ولا يحمي العاملة من محاولات الاغتصاب والتحرش.
ويشير الجردي أيضاً إلى تدني أجور العاملين في الخدمة المنزلية، ليرى أنه يجب أن يكون مماثلاً في حده الأدنى للحد الأدنى لأجر العامل اللبناني، فـ»مشروع القانون المقترح مخصص لجميع العاملين في الخدمة المنزلية من دون تحديد جنسيتهم، ولبنان وقع على اتفاقيات العمل الدولية التي تنص على عدم التمييز في الأجر بين العمال تبعاً للجنس أو اللون».
من زاوية أخرى، ترى ديمة حداد، الناشطة في جمعية «كاريتاس»، أن مشروع القانون المقترح «لا ينص صراحة على معاقبة وتجريم الانتهاكات التي يتعرض لها العمال المنزليون، بدءًا من حجز الحريات وتقييدها، وصولاً إلى التعنيف النفسي والجسدي». كما أنه، وفق حداد، «لا يشير إلى جرم الاتجار بالبشر، ولا يلحظ تجريم ومعاقبة التمييز على أساس الجنس أو العرق، ولا يقدم تعريفا واضحاً لمهمة الخدمة المنزلية المطلوبة، ما يفسح المجال أمام إشكالات كبيرة يمكن أن تطرأ نتيجة الالتباس حول مهام العامل أو العاملة». وترى حداد أن اعتماد القانون على نظام الكفالة يتعارض مع أبسط حقوق الإنسان والتزامات لبنان الدولية.
قتيلة في كل أسبوع
سجّلت تقارير الشرطة اللبنانية، أربعين حالة انتحار لعاملات أجنبيات، خلال العام الماضي وحده، كما سجّلت أربعا وعشرين حالة وفاة بسبب السقوط من أماكن شاهقة، وحالتي وفاة بسبب الضرب المفضي إلى الموت.
«كانوا يعاملونني كأنني عبدة»، هكذا كتبت العاملة الأثيوبية «بيركتي مادي كاسا» لإحدى صديقاتها قبل إقدامها على الانتحار. أما «ساردا»، السيدة النيبالية، فتقول إن مواطنتها «بويال» انتحرت لأنها يئست من قبض مستحقاتها المادية، بعدما طالبت بها طوال خمسة أشهر، تحت ضغط زوجها المريض عليها لإرسال النقود إليه.
تقول «ايلامي» إن المطاف انتهى بصديقتها الفيليبينية إلى الانتحار بعدما اتهمها ربّ عملها في منطقة طريق الجديدة بسرقة قطعة مجوهرات، وقام بضربها وحبسها داخل المنزل لأسابيع عدة، مؤكدة أن مواطنتها المتوفاة أخبرتها عن محاولات دائمة من رب المنزل وابنه للتحرش جنسياً بها.
ولا تخرج قصة «انلين»، الفتاة الفيليبينية، عن السياق عينه. فبعد وصولها بيومين إلى منزل رب عملها في أميون في قضاء الكورة، بدأ الأخير باغتصابها مستغلاً غياب زوجته في عملها، مهدداً إياها بالقتل في حال رفضت التجاوب معه.
تمكنت «انلين» من الهرب بمساعدة احدى صديقاتها، وهي تعمل اليوم في أحد فنادق بيروت بلا أوراق ثبوتية.
ويؤكد مدير مكتب منظمة «هيومن رايتس ووتش» في بيروت نديم حوري لـ«لسفير» أن «عاملات المنازل الوافدات الى لبنان يلقين حتفهن بمعدل أكثر من عاملة في الأسبوع الواحد، وهذا دليل واضح على ان الدولة اللبنانية لا تبذل ما يكفي من جهد لتخفيف الاوضاع الصعبة التي تعيشها هؤلاء النسوة». ويعتبر حوري انه «من واجب الحكومة وسفارات بلدان العاملات المتوفاة ومكاتب الاستخدام أن يوضحوا كيفية مغادرة هذا العدد الكبير من العاملات في أكفان». ويرى حوري أن السبب الرئيس للمشكلة يكمن «في استبعاد قانون العمل اللبناني للعاملين في الخدمة المنزلية، إذ رغم صدور عقد نموذجي موحد في العام 2009 عن وزارة العمل يضع معايير جديدة متقدمة لاستخدام العاملات الاجنبيات، فإن التدابير تبقى حبراً على ورق، طالما ان الحكومة اللبنانية لم تعين مفتشي عمل لضمان الالتزام بالقواعد الجديدة». ويعتبر حوري أن حبس أصحاب العمل للعاملات المنزليات في المنازل جريمة يعاقب عليها القانون، و»على الشرطة أن تتعامل مع الوضع من هذا المنطلق».
عيّنة عن تحقيقات ليست جديّة
كثيراً ما تحقق الشرطة اللبنانية في حالات وفاة العاملات الأجنبيات. وتظهر الوقائع أن الكثير من العيوب يشوب تلك التحقيقات. فغالباً ما تقتصر على أسئلة عامة والأخذ بشهادة أصحاب العمل، من دون التحقق من صحّة أقوالهم ومقارنتها بشهادات الجيران، وغالباً ما لا تحقق الشرطة اللبنانية في ما إذا كان أصحاب العمل قد أساؤوا إلى العاملة أم لا.
وبتاريخ لم يمر عليه الزمن، أحضرت الى «مستشفى دار الأمل الجامعي» في بعلبك جثة الفتاة النيبالية «ميس سيتا غارينغ»، وهي مصابة بطلق ناري في بطنها. تولّى مخفر بعلبك التحقيق، واستدعى رب العمل الذي أفاد بأن غارينغ أطلقت النار على نفسها. ختم التحقيق على هذا الأساس، وترك المستدعى حرّاً بناء على اشارة المحامي الاستنئنافي، بعدما تعهد بدفع مصاريف المستشفى واستلام الجثة وإتمام معاملات نقلها إلى ذويها. في المقابل، يطرح تقرير الطبيب الشرعي الذي عاين الجثة أكثر من علامة استفهام، إذ يشير إلى وجود كدمات على وجه غارينغ، وعلى الجهة الخارجية للزند الأيسر، والجهة اليمنى واليسرى للفك الأسفل، وتحت العين للجهة اليسرى، كما أن الفحوصات أظهرت تمزق غشاء البكارة ووجود حرق ناري على إصبعي الابهام والسبابة لليد اليسرى.
تقول إحدى العاملات القادمات من مدغشقر لمعدي تقرير «هيومن رايتس ووتش» حول أوضاع العاملات المهاجرات إلى لبنان، إنها اعتقدت «أن الشرطة هنا مثل مدغشقر تذهب إليهم عندما يكون لديك مشكلة» ليتبين لها أنهم «هنا هم جزء من المشكلة».
ينطبق الواقع ذاته على «ايمييه» المدغشقرية التي تعرضت للضرب المبرح من قبل عنصر من قوى الأمن الداخلي في وضح النهار في أحد شوارع رأس بيروت. فبعدما حاولت «إيمييه» مساعدة مواطنتها التي تعمل في منزل العنصر الأمني على التخلص من معاملته السيئة، اعتدى عليها بالضرب. تقدمت «إيمييه» بشكوى بحق رجل الأمن الذي أنكر علاقته بالموضوع، على الرغم من وجود عدد من الشهود، ومع ذلك، لم تفض التحقيقات التي أجرتها القوى الأمنية إلى «العثور على الفاعل».
ويدفع الواقع بعاملات المنازل الأجنبيات إلى عدم التقدم بشكاوى أو متابعتها ضد أرباب عملهن، وهنّ في حال تقديمهن لشكوى، يلمسن أنها كثيراً ما تواجه بلامبالاة من قبل الشرطة، بالإضافة إلى شعورهن بخوف دائم من الاتهامات المضادة من قبل رب العمل الذي يميل أفراد الشرطة إلى تصديقه من دون التثبت من أقواله. بالإضافة إلى ذلك، فإن سياسة التأشيرات التقييدية التي تتبعها السلطات المحلية تجعل من الصعب عليهن البقاء في لبنان لمتابعة الدعاوى أمام القضاء المختص.
«نظام الكفيل أساس المشكلة»
أمام تلك الوقائع كلها، ترى المحامية من منظمة «كفى» موهانا إسحاق أن «نظام الكفيل يأتي في قلب الفشل القضائي في حماية عاملات المنازل الأجنبيات»، حيث تتعرض «أي عاملة تتقدم بشكوى ضد رب عملها لفقدان عملها، وتالياً احتمال الاعتقال والترحيل». وتشير إسحاق إلى أن السواد الأعظم من العاملات الاجنبيات في لبنان يواجهن القانون من دون تمثيل قانوني مناسب، ومن دون وجود مترجم، وأن عدداً كبيراً من محاضر الشرطة يشير الى أن العاملة قالت في أثناء التحقيق أنها تتكلم القليل من العربية، ومع ذلك، تابعت الشرطة تحقيقاتها من دون مترجم. وترى اسحاق أن «السبب الرئيسي للتوترات بين أرباب العمل والعاملات المنزليات هو عدم دفع الأجور»، مسجلة اعتراضها على «حجز أرباب العمل جوازات سفر العاملات لديهم بذريعة ضمان عدم الهرب الى منزل آخر للعمل من دون التعويض عليهم». وتؤكد أن «الوثائق الشخصية هي ملك حصري لاصحابها، وهذا ما تقره الاعراف والشرائع الدولية».
وتأكيداً على الشوائب التي تعتري التحقيقات، تشير دراسة أعدتها «هيومن رايتس ووتش» حول متابعة 13 قضية جزائية رفعتها عاملات ضد أرباب العمل بسب سوء المعاملة، تبين أن تلك القضايا استغرقت في المتوسط 24 شهراً، بدءاً من موعد تقديم الشكاوى حتى موعد التوصل إلى قرار، فيما استمرت الشكاوى أمام المحاكم المدنية لفترات أطول، وصلت إلى 54 شهراً.
وتوثق الدراسة عدم وجود أي حــالة ملاحقة لأرباب العمل من قبل السلطات المختصة لحبسهم العاملات داخل منازلهم أو حجزهم لجوازات سفرهن أو حرمانهن من الطعام، مستندة إلى 114 ملف شكاوى راجعتها المنظمة.

With some 200,000 domestic migrant workers employed in Lebanon, there’s certainly a market for this new concept, the first of its kind in the country: a training center for maids.

“Most people have some kind of problem with their maid but there is one simple solution to this and that is knowledge,” center founder and director Rachid Beydoun told the Daily Star.

At a starting cost of $180, The House Keeper Training Academy teaches maids how to clean and use proper etiquette. The four-day course also offers basic language instruction and provides information on migrant worker rights.

While the new center could be seen as a welcome move to improve conditions for maids in Lebanon, it’s also stirring some controversy.

"I think the heart is in the right place in terms of trying to work on the issue, but
it has misplaced all effort," Alex Shams, a coordinator for the Migrant Workers Task Force in Lebanon, said in a phone interview.

"They reference, for example, an attempt to bridge the gap [between employer and worker] because they assume the issues and misunderstandings come from a language barrier and lack of knowledge, when we know that's just not the case."

The approach is incorrect because it has a blame-the-victim attitude, according to Shams.

"The person that needs to be reformed is the abuser, not the abused... The most dangerous part is that it suggests that it is somehow the victim's fault. It confirms many stereotypes about domestic workers as people who are stupid or don't know what they are doing."

In some ways, he says, "You're basically spending $200 so that you won't beat your maid."

"If you are going to beat your maid you're going to beat them whether they use the right cleaning product or not."

As a response to the new center, the Migrant Workers Task Force has set up an event on Facebook offering courses in their own "Madame/Mister Training Academy," parodying what they see as the misguided attempt to help domestic migrant workers.

The event aims to inform the employers "how to treat a domestic worker who comes to live in their home with respect and dignity," thereby placing the blame not on "miscommunication, but widespread human rights abuses in Lebanese society."

Domestic workers are generally admitted to resorts under conditions specifying how they dress and behave on the premises.

A handful of resorts also don’t require entrance fees for workers, on the condition that they don’t swim.

At La Guava domestic workers are charged about the same price as children while at Bamboo Bay they are not allowed to swim or sit on the lounge chairs, and at Tabarja’s Aqua Marina 2, they must remain in an area set aside for them alone.

Madagascar to export labour to Jordan

The government of Madagascar will send 3,000 workers to Jordan by the end of the year, a minister has said.

Attempted suicide of an Ethiopian from a hospital

Al-Akhbar newspaper reported today the suicide attempt of an Ethiopian lady, Tseha K., who jumped from the first floor of a hospital in el-`Azounieh - Mdeirej, where she was being treating for a nervous breakdown. She sustained injuries in the head and hip. Information by security forces said that this was not the first suicide attempt of the Ethiopian woman.

As a confirmation to our previous post, As-Safir newspaper reported today that a Bengali domestic worker attempted to commit suicide from an employment agency building, after being denied return to her country. She was taken to the police station, and her fate remained unknown at time of publishing of the news piece, according to As-Safir.

ويؤكد علي فخري من «حركة مناهضة العنصرية»، الذي زار المخفر وتواصل مع السفارة لإيفاد مترجم رسمي للمواطنة البنغلادشية، أن «لا قوى الأمن أو لا صاحب مكتب استقدام الخدم، اتصلوا بالسفارة البنغلادشية لطلب مترجم لريهانا، التي لا تتقن إلا لغتها الأم! وعوضاً عن ذلك، تمت الاستعانة بعامل في محطة وقود، بنغلادشي الجنسية، ما لبث أن طلب منه عناصر قوى الأمن الخروج من المخفر، من دون أن يتم تحديد مصير المواطنة البنغلادشية».
في المقابل، يجزم صاحب المكتب بلال حمود بأن «المواطنة وصلت إلى لبنان منذ أربعة أيام، وقد حاولت الهرب لا الانتحار، وتم أخذ أقوالها بعد وصول مترجم من السفارة البنغلادشية، وسوف يتم العمل على إعادتها إلى ديارها».
وفي الاتجاه ذاته، أكدت مصادر أمنية لـ»السفير» أنه «تم ارسال مترجمة من السفارة البنغلادشية، وشرحت لها الآلية المتبعة لترحيلها إلى ديارها مجدداً، علما بأن مسؤولية إعادتها إلى بلدها الأم تقع على صاحب مكتب الاستخدام في حال لم ينقض على وصولها إلى لبنان أكثر من ثلاثة أشهر».
تجدر الاشارة إلى أنه حتى الخامسة من بعد ظهر أمس، بقي مصير المواطنة البنغلادشية غير محدد، إذ كان صاحب مكتب الاستخدام والكفيل بانتظار الرد من المدعي العام.

A U.S. report on human trafficking has placed Madagascar in the lowest category and claims the country's de facto government has done nothing to crack down on the practice of sending thousands of women to the Middle East, where the majority of them encounter forced labor and abuse. The new report reduces prospects of the U.S. resuming non-humanitarian aid to the island nation, to which it suspended aid in 2009 following a coup.

The new report claims Madagascar has increasingly become “a source country for women and children subjected to forced labor and sex trafficking,"
particularly since a March 2009 coup sparked an economic crisis and “a decline in the rule of law."

The report says Madagascar's government has done little to prevent the sex trafficking or to prosecute so-called job agencies and government employees that recruit vulnerable women, often from poor, rural areas, and trick them into leaving for lucrative contracts in the Middle East.

About 800 women have returned home from Lebanon since 2009, with most women ending their contracts early because of mistreatment. Seventeen bodies have also been shipped home from Lebanon.

The women bring back stories of torture, physical, psychological and sexual abuse, and harsh working conditions with little or no pay and little or no opportunity to escape contracts.

Over 7,000 women from Madagascar are known to work as maids in Lebanon, and in March the government repatriated 86; including 59-year-old former nurse Abeline Baholiarisoa. She says a job agency offered a false three-year nursing contract in 1986 that led to 15 years forced labor as a maid.

She says on arrival for her new job the agency said her contract was null and void and was designed only to get her out of the country. She said her life and the lives of her children were shattered.

With her identification papers taken away, Baholiarisoa says she suffered mistreatment and near-starvation as a domestic servant working up to 24 hours a day for a salary that barely covered her costs.

A government ban on sending workers to Lebanon has failed to address the problem, with women being sent through countries like Mauritius and the Seychelles to end up in Lebanon, and more recently, Dubai and Kuwait.

Madagascar's Minister of Population Nadine Ramaroson, named in the report for trying to bring these women back with little help from other government officials, says the problem dates back to the 1990s. She said it is a crime network that involves government workers and is very tough to break.

Abeline agrees with the report’s demands that Madagascar needs stronger relations with Lebanon or women will continue to be lost and open to abuse.

She says these women need a doctor, lawyer, social worker and journalist out there, otherwise they will always be at risk of exploitation.

The U.S has criticized the government’s reactive approach to the problem, which has failed to use anti-trafficking laws or awareness campaigns to stop women, by the hundreds, being sent from Madagascar’s shores.

More than 600 women are still awaiting repatriation from Lebanon, with charities saying a quarter of them are emergency cases. Meanwhile, few resources have been given to provide psychological, medical and financial support to the many traumatized returnees.

It is estimated that there are some 50 to 100 million domestic workers worldwide. The vast majority of these workers are young girls and women, and a large percentage of them are migrants. They serve as nannies, housekeepers, cooks, and caregivers who are most densely concentrated in the Middle East and Asia. Since they are often excluded from workers' and laborers' rights schemes, they often
suffer from unpaid wages, excessive hours, little time off, and a high frequency of physical and sexual abuse, making them some of the most exploited workers in the world. Additionally, their status as young, impoverished, foreign females, further contributes to their vulnerability and marginalization. During its annual conference this month, the International Labor Organization adopted a historic treaty that aims to create an international standard for protecting the rights of migrant domestic workers for the first time. The Convention on Domestic Workers [PDF] strives to establish standards that bring the rights of domestic workers in line with the rights more commonly enjoyed by individuals who are employed outside the home. The convention states that domestic workers must work reasonable hours, must have a weekly rest of at least 24 consecutive hours, limits in-kind payment, requires clear information on terms of employment, a minimum wage, and basic rights such as freedom of association and collective bargaining.
The adoption of the treaty by most delegates from Arab nations was remarkable due to both the large number of migrant domestic workers employed in the region and their previous opposition to the convention. Previously viewing the effort as unnecessary and impractical, suggesting that workers employed in the home were treated as members of the family, the delegates' change of heart signals an important and necessary step toward the radical change in thinking that must take place regarding the rights of domestic workers. However, despite supporting the convention, the delegates quite aptly highlighted challenges to ratification, implementation, and enforcement in their respective countries.
Last year, Human Rights Watch (HRW) released a 54-page report entitled "Without Protection" that detailed the treatment of migrant domestic workers in Lebanon. It uncovered a particularly grim reality for the nation's estimated 225,000 migrant workers hailing from Sri Lanka, the Philippines, Ethiopia, and Bangladesh, among others. The report reviewed over 100 judicial decisions concerning various complaints made by migrant domestic workers and did not find a single instance in which employers that had forcibly confined workers to the house, confiscated their passports, or denied them food were actually charged with a crime. It further found that the lack of a viable and accessible complaint reporting mechanism, lengthy judicial proceedings, and a restrictive visa policy further discouraged many from pursing or even reporting abuses of their rights in the first place. Based on the cases reviewed, HRW estimated that criminal claims took an average of 24 months to resolve, that complaints for unpaid wages took between 21 and 54 months, and that even simplified complaints made in labor courts took an average of 32 months. Additionally, under Lebanon's work visa sponsorship system, a worker who leaves an employer, even to file a legally viable complaint, forfeits her right to stay in Lebanon and faces potential detention and deportation as an illegal alien.
Nonetheless, to say that abuse is not prosecuted altogether would be incorrect. For instance, some cases of severe abuse have been prosecuted but they continue to be rare and unfailingly result in lenient sentences. For example, in a widely hailed case from December 2009, an employer was convicted of repeatedly beating her domestic worker. However, the sentence was only 15 days. In another similar case from June 2010, a Lebanese criminal court issued what appears to be the most severe sentence to date to an employer who repeatedly beat and forcibly confined her domestic worker to the house. Yet the sentence was just one month.
Perhaps a testament to the harsh working conditions in Lebanon is the HRW finding that on average more than one migrant domestic worker dies every week, either as a result of suicide or during an attempt to escape from the high-rise apartments their employers confine them to. The Filipino government's 2007 decision to ban their citizens from working in Lebanon is another testament to the subpar conditions workers face. Likewise, nations such as Sri Lanka and Indonesia have introduced significant measures to better protect their citizens employed as domestic workers in Lebanon.
Lebanon has made attempts to ameliorate the situation through legislation. For example, it recently adopted measures to regulate employment agencies and to adopt a mandatory standardized contract that would include provisions such as at least one day off a week. Furthermore, the Lebanese Ministers of Labor and the Interior recently brought the situation to the attention of the parliament with promises of reform. However, while currently marked by relative calm compared to much of the Middle East, Lebanon has dealt with a series of disputes, setbacks, and political changes that have left the central government paralyzed since January. Accordingly, attempts at reform have languished and the measures seeking to regulate employment agencies and standardize contracts still need to be implemented properly.
Nevertheless, legal discussions, attempted legislative reform, and even the ratification of international treaties is arguably simple in comparison to fomenting the radical change in thinking that the region needs to undergo in order to see these reforms implemented. In Lebanon, conventional wisdom dictates that domestic workers are little more than servants attached to a household. As such, they are accorded very little respect. Their personal rights and freedoms even less so.
For example, it is widely accepted in Lebanon that the initial investment an employer makes in bringing domestic workers into the country justifies restrictions in the workers' movement, both through confiscating their travel documents and through confining them to the house. This is viewed as rightfully limiting the employer's risk of loss as it makes it virtually impossible for the worker to run away. This mentality makes the complete forfeiture of the freedom of movement one of the normative expectations of the job, and it is even prevalent among employers that generally treat their domestic employees well in other ways. It is particularly common in the early stages of employment before some level of trust has been established between employer and employee.
While the existence of more extreme forms of abuse are concerning and should be taken seriously, the more pervasive and alarming issue in Lebanon is the fact that otherwise relatively humane individuals, who would never physically harm an employee, think nothing of practices that are most certainly still forms of abuse. This is derivative of a mentality in Lebanon, and the region in general, which condones the substandard and inhumane treatment of these workers. This mentality arises from prejudice, a disdain for poverty, and what is viewed as degrading work. The failure of both the nation's police and prosecutors to take instances of physical violence against migrant domestic workers seriously, often turning a blind eye to it altogether, and the failure of the nation's lawmakers to effectively implement protections and accord rights to migrant domestic workers, serves to demonstrate the widespread and pervasive nature of this mentality.
What is encouraging, however, are several recent events that suggest a trend towards a more humane view of domestic workers in Lebanon. Just a week after the Arab delegates to the ILO conference supported the adoption of the convention, the UN Country Team in Lebanon adopted a voluntary code of conduct reflecting many of the convention's principles. This code was intended to set a trend in the region and will be followed by all UN staff in Lebanon. Even more suggestive of a changing mentality are the many grassroots efforts raising awareness and providing much needed services and education to migrant workers. This trend can be witnessed in the proliferation of blogs and Facebook groups, and in the activities of local NGOs that serve as safe havens and centers for education and socialization.
It appears that at least a portion of Lebanese society, and perhaps a sizable portion of the younger generation, are beginning to develop a more humane view of domestic workers. This will hopefully carry over to law enforcement officials and labor inspectors, aiding them in identifying and seriously prosecuting violations against domestic workers. With any luck, it will also encourage Lebanon's parliament to seriously reform the sponsorship system and properly implement the regulations that have already been adopted.

Action against those exploiting Lankan workers

Minister of Foreign Employment and Welfare Dilan Perera dismissed reports from certain media organisations that Sri Lankan women employed in a Jordanian factory were being repeatedly raped. The Minister made the statement at a press briefing held in Colombo.

“I immediately assigned a delegation to visit this factory in Jordan as soon as I became aware of this news. They launched an investigation. Based on the report submitted by the delegation, I can confirm that the factory employs 5,000 workers of which 1,850 are Sri Lankans and no one acknowledged the alleged incidents”, he said. However, recounting a different incident, the Minister acknowledged that Sri Lankan domestic worker Indra Malkanthi had been forced to swallow nine nails by her employer in Lebanon.

She is now in a stable condition in hospital after undergoing surgery to remove the nails from her stomach. “Two officials from our embassy in Lebanon have been deployed to attend to her needs and she will be flown to Sri Lanka as soon as her doctors declare her fit to travel. The local agent in charge of her employment has been ordered to cease operations temporarily”, he said.

Minister Perera also disclosed that he plans to increase the age floor of Sri Lankans going overseas for domestic employment from 21 to 30 years over the next three years to ensure their safety and security. He pledged to take action against anyone who exploits Sri Lankan workers abroad.

On suicides in Lebanon

He identifies a small minority as “genuinely ill psychiatric patients,” and defines others as “suicide gestures” or “serious attempts.”
“What we see is a lot of suicide-like behavior … they take a few pills and then come in for drama and attention,” he says, mentioning the case of a teenager who was admitted a few days earlier after an overdose.
“She had just broken up with her boyfriend and didn’t really want to kill herself,” he says. “I had to tell her about the other 3 billion other men on the planet that can break her heart in the future.”
He contrasts this with cases of foreign domestic workers, mainly young Philippine and Sri Lankan young women, who try to kill themselves by jumping off buildings or ingesting toxic products and are, as he defines them, “deadly serious.”
“I remember a Philippine national who had drunk a very toxic product … the surgeon’s gloves melted on the inside,” he says.

Will Arab states ratify historic international labour standards on domestic work?

Arab governments, workers and employers have largely supported the adoption of the Convention and Recommendation on Decent Work for Domestic Workers, and must now consider ratification

Geneva (ILO News) - Most Arab delegates to the International Labour Conference supported the adoption of historic international labour standards on decent work for domestic workers on Thursday (June 16), with only a handful of abstentions. But some highlighted the challenges to ratification and

implementation in Arab countries.

The region hosts a significant number of migrant workers - some 22 million - one third of whom are women engaged in domestic work, originating from Asian and African countries such as Sri Lanka, the Philippines, Bangladesh, Nepal, Indonesia and Ethiopia.

The number of migrant domestic workers varies from country to country. While Saudi Arabia hosts some 1.5 million migrant domestic workers, estimates for Lebanon (225,000) and Jordan (77,000) are much lower.

These workers are largely excluded from national labour legislation, social security regimes and occupational health and safety provisions and are often tied to their employers through a restrictive sponsorship system. The majority of them have their passports and papers taken away by their employers and are not allowed outside the home on their day off. The informal, unregulated and isolated nature of their work renders them vulnerable to exploitation and abuse.

ILO Convention 189 and Recommendation 201 on Decent Work for Domestic Workers set out that domestic workers who care for families and households must have the same basic labour rights as those available to other workers: reasonable hours of work, weekly rest of at least 24 consecutive hours, a limit on in-kind payment, clear information on terms and conditions of employment, as well as respect for fundamental principles and rights at work including among others freedom of association and the right to collective bargaining.

Under international law, the next step for Member States will be to submit the new labour standards to their national competent authority for enactment or other action, including ratification. Ratification would mean accepting the Convention and Recommendation as legally binding instruments and would require ensuring they are applied through harmonizing national legislation and other methods.

Whether or not Arab governments will ratify or seek to implement the new standards remains to be seen.

“There is an Arab consensus on the adoption of the Convention and Recommendation on Decent Work for Domestic Workers but there are major obstacles to implementation at the national level,” said Bahraini Workers' delegate Ibrahim Hamad. “Far-reaching legislative changes will have to be made in the countries that host the vast majority of migrant domestic workers, such as the Gulf Cooperation Council states.”

Saudi Workers’ delegate Nidal Mohammad Radwan agreed that it would take some time to achieve ratification, but said significant efforts are already underway in several Arab countries to bring national laws in line with international standards: “There is a debate in Saudi Arabia at the moment about introducing new regulations - such as an insurance scheme - to better protect domestic workers and the families that employ them. If these laws are passed, Saudi Arabia would move closer towards ratification.”

Speaking on behalf of the Gulf Cooperation Council countries at the Domestic Workers’ Committee meeting, United Arab Emirates Government representative Humaid Rashid Bin Demas noted that a unified labour contract for domestic workers had been adopted in Kuwait, and new legislation in the UAE would allow for labour inspection in private households.

Convention 189 on Domestic Workers (2011) was adopted by a vote of 396 to 16, with 63 abstentions and the accompanying Recommendation 201 by a vote of 434 to 8, with 42 abstentions. The Convention is an international treaty that is binding on Member States that ratify it, while the Recommendation provides more detailed guidance on how to apply the Convention.

Ten of the 63 abstentions were registered by Arab delegates, mainly employers who underlined their support for bringing domestic work into the mainstream and addressing human rights concerns but also voiced reservations.

In 2010, the Employer’s group had favoured a stand-alone Recommendation in preference to a Convention explaining that an overly prescriptive Convention could suffer a low ratification rate. Employers have also emphasized the unique nature of domestic work, which takes place in the home, where family rights must be respected.

“One of the greatest challenges to implementing this Convention and Recommendation, especially in Arab countries, is how to conduct labour inspection while respecting the privacy of homes. Labour inspectors everwhere do not have the right to enter homes. So this could be one of the greatest challenges for Arab countries,” said Egyptian Government delegate Iman Nahas.

Many believe that, in order to be effective, legislative changes would have to be accompanied with - or indeed preceded by - a change of mindset.

“It is easy to discuss legal texts and conventions, and we may even amend national legislation and ratify conventions, but the real challenge is how to make these principles a reality. In discussing and adopting this convention, we have accepted an international and national obligation. We hope that our committment to domestic workers will be both a legal and a moral one,” said United Arab Emirates Government delegate Humaid Rashid Bin Demas.

“There is a genuine need for awareness-raising in Arab countries, to develop a more humane view of domestic workers and to recognize that domestic workers are real workers, not servants,” added Bahraini Workers’ delegate Ibrahim Hamad.

The vote took place at the annual 100th International Labour Conference in Geneva, Switzerland. The ILO is the only tripartite organization of the UN, and each of its 183 Member States is represented by two government delegates, and one employer and one worker delegate, with an independent vote. A two-thirds majority of votes is required for a standard to be adopted.

The call for a standard to protect domestic workers was first mooted at the ILC in 1965.
